Miloš Medenica was unjustifiably detained, the judges of the Constitutional Court said.
This was confirmed to "Vijesta" by Medenica's defense attorney, lawyer Stefan Jovanović, stating that the decision of the Constitutional Court is a confirmation of everything they pointed out during the proceedings.
"...And that is that the detention in this particular case was neither justified nor necessary, and that my client's right to freedom was violated. It is clear to the experts, but for the sake of the public, let me explain and remind you - my client, Miloš Medenica, after completing the treatment, immediately returned to Montenegro and made it available to the competent authorities, thus enabling the Special State Prosecutor's Office to conduct an investigation in relation to him, and later to the High Court, to try him without hindrance," said Jovanović.
He added that even before the order to conduct the investigation was passed, the competent authorities knew that his client was undergoing treatment: "And what was the medical documentation submitted about".
"In addition, a proposal was submitted to the High Court for the determination of bail in the amount of almost 790.000 euros, in such a way as to constitute a mortgage in favor of the state on real estate owned by the victim, his mother and sister, and at the same time with the determination of supervision measures according to the position of the court. Therefore, despite the fact that the Constitutional Court found a violation of the right to freedom to the detriment of my client, there is still a proposal for bail with supervision measures as a guarantee that the proceedings will proceed smoothly, that is, that the presence of the accused will be ensured I expect that the judges of the regular courts - Appellate and Higher, as legalists and dispensers of justice, upon receiving the decision of the Constitutional Court of Montenegro, will appreciate the determination we are finally talking about and that they will allow Miloš Medenica to defend himself from freedom after 16 months of detention. Miloš Medenica was arrested on May 25, 2022, at the Podgorica airport, after entering Montenegro from Serbia.
