The decision of the Minister of Justice Marko Kovač rejecting Kosovo's request to extradite Serbian citizen Momcilo Vukotić for prosecution for a criminal offense, who was arrested in Montenegro and is in extradition custody, is neither legally nor politically good, announced the Democratic Party of Socialists ( DPS).
They said that they hereby indicate that "as a reason for such a decision, Kovač cited the violation of Article XNUMX of the European Convention on Human Rights and Fundamental Freedoms, as well as the suspicion that Vukotić may be politically prosecuted."
According to the DPS, such a legal interpretation does not stand in any case, primarily because the court considered a possible violation of the European Convention and made a decision to extradite Vukotić.
Another reason why Kovač should not have made such a decision, they stated, is the very seriousness of the crime
"We remind you that Vukotić is charged with war crimes against the civilian population, and extradition can be carried out between mutually recognized states, which is the case with Montenegro and Kosovo. When we take into account what has been said, and knowing the position of subjects of the Government of Montenegro and its ministers, the conclusion is that Kovač made a political decision, based on the technical implementation of the directive he received from Belgrade," DPS announced.
