Vladimir Bajčeta has been illegally detained for more than 15 days, without a decision of the High Court, announced his defense attorney, lawyer Dušan Jovović, adding that it is worrying that it is not known on what basis the man from Podgorica is still in the Investigation Prison.
Jovović told Vijest that he submitted a proposal to the court to terminate Bajčeta's detention.
"I have submitted a proposal to cancel the custody of Vladimir Bajčeta, due to the fact that he has been illegally detained without a court order for more than 15 days. Bearing in mind that the decision of the competent court was not made in the specified period, nor was it forwarded to the defense attorneys or the Administration for the Execution of Criminal sanction, it is worrisome on what grounds and on the basis of which decision the UIKS administration keeps this defendant in custody," he said.
Jovović added that the courts did not find it appropriate to decide on the reported appeal, even though the relevant procedure and deadline are clearly prescribed by law, which is why the defendant suffers the consequences of the court's failure to act in illegal detention.
"From the foregoing, as my client's rights to the procedural rules of procedure, and the rights to freedom and a fair trial were indisputably violated, they can only be removed by abolishing illegal smuggling. So in this case, the Constitution of Montenegro and the Convention were violated, which is why I appealed to the panel of the competent court for the abolition of illegal detention. It should be noted that the same treatment is also given to the other defendants in the same case," said Jovović.
