The Higher State Prosecutor's Office (VDT) requested that misdemeanor proceedings be initiated against Boban Batrićević due to the views expressed in the column published on the Antene M portal.
The prosecuting spokesperson of VDT Lepa Medenica told "Vijesta" that the criminal complaint against Batrićević was filed by Podgorica lawyer Dejan Dragović for the criminal offense of inciting national, racial and religious hatred.
Batrićević does not answer the numbers available to the "Vijesti" newsroom.
Medenica says that after evaluating the file, the VDT found that there were no elements of the reported criminal act.
"Nor of any other criminal offense for which he is being prosecuted ex officio, but that in this particular case it is a misdemeanor, for which reasons the request to initiate misdemeanor proceedings was submitted," said Medenica.
The decision of the acting prosecutor states that Batrićević committed an offense under Article 19 of the Law on Public Order and Peace. In that article of the law, a sanction of 250 to 1.500 euros or a prison sentence of up to 60 days is provided for anyone "who in a public place by speech, inscription, sign or otherwise insults another on the basis of national, racial or religious affiliation, ethnic origin or other personal properties".
Batrićević stated for CdM that he received a summons to appear as a defendant at the Court for Misdemeanors in Podgorica on January 22, 2024. He also said that "there is no prosecutor's office and no court" that will force him "to remain silent on the celebration of war criminals."
