Lawyer Damir Lekić today proposed in the Podgorica Basic Court that in the proceedings for the activation of explosives in the "Štrudla" bar, the indictment of the Special State Prosecutor's Office (SDT), which also deals with that event, should be used as evidence.
He said this at the main hearing in the case against Ćazim Turusković and Aleksandar Dacić, who are accused of having activated an explosive device in that restaurant.
Lekić recently informed the public that the SDT and the Basic State Prosecutor's Office in Podgorica filed indictments for the same event.
He assessed such actions of the prosecutor's office as scandalous, explaining that different people were blamed for the explosion in the center of Podgorica on January 27, 2020.
"I handed over the indictment of the SDT, which treats in terms of time, place and manner of execution, this same life event, when an explosive device was activated at the catering establishment 'Štrudla', but in that indictment, according to the evidence collected by the SDT, that was done by other persons, and not by the defendants Ćazim Turusković and Aleksandar Dacić. I proposed that the indictment of the SDT, as well as the case files of the High Court in Podgorica, the department for the suppression of organized crime, bribery, corruption, terrorism and war of the crime, according to which they were formed, will be used as evidence," said Lekić to "Vijesta".
He stated that state prosecutor Marija Kažić did not object to this yesterday, but that she did not agree with it either.
"She left the submission of the evidence proposal for evaluation by the court. The judge accepted the submission of the evidence proposal and ordered that the indictment be inspected, as well as the aforementioned case files, after they are obtained by the Higher Court in Podgorica," Lekić said. .
He said that after that he asked for exemption from further proceedings in the case of the head of the Basic State Prosecutor's Office in Podgorica, Duško Milanović, and the acting state prosecutor, case handler Biljana Medenica.
"With the explanation that it is completely impossible that they were not aware of this fact that there are two proceedings, i.e. now two indictments, and this bearing in mind the hierarchy, organization and work of the State Prosecutor's Office with a special note that the proceedings in the SDT case are ongoing for a long time, not since yesterday, and that so far he has gone through several phases - namely the reconnaissance phase, the investigation phase, and the control hearing and indictment confirmation phase... and that it is simply impossible that they were not in mutual communication with the SDT in to which the SDT informed them that after them, for the same life event, it began to prosecute completely different persons who have no contact points with the one they are prosecuting before the Basic Court in Podgorica, and that, after receiving that mandatory notification, they did not undertake any action to prevent it or to create conditions so that it no longer exists and to stop it," Lekić said.
On the contrary, he added, ODT still persists in its criminal prosecution, which, he said, is tantamount to a scandal: "These are really circumstances which, to be blunt, point to all kinds of things, not only to the bias of the head of ODT in Duško Milanović and Biljana Medenica from Podgorje to the detriment of Turusković and Dacić".
