Former president of the Basic Court in Cetinje Jelena Perović at one time she asked for and received suggestions from Vesne Medenica - how to act in individual cases, according to the transcripts of their conversations, which are part of a case against the former president of the Supreme Court.
Despite their clearly defined mutual relations in the positions they covered, the current director of the Agency for the Prevention of Corruption (ASK) during 2020 consults with the head of the judiciary at the time - whether to order someone's detention or to cancel detention, but also apologizes for case the plea agreement was not accepted, informs her who applied for which positions in the judiciary...
"President, I have to tell you that the NP advisor is one of the few who is so dedicated to work and the court. Loyal to law and justice. I know there are criteria, but it seems to me that this feature cannot be recognized unless we say which one it works for. I simply had a moral obligation to tell you this. Excuse me on the loose. Greetings", she writes on March 17, 2020 to Medenica with a smiling emoticon.
She urged for another counselor a few months later:
"How are you? I forgot to tell you that she is my advisor not a word pleaded guilty to misdemeanors. She is really great, a good person, from a family of intellectuals from Cetinje, Montenegrin... Everything is in its place", writes Perović on June 15, 2020.
Perović, as he writes, informs Medenica about the wounding of Cetinje Saša Jabučanina i Nedeljko Perović, explains to her who Jabučanin is related to, that he wounded them Taso Jovanovic. He also reports on the condition of the wounded.
He also informs her about a property proceeding in the capital and informs her that the case ended up in the High Court in Podgorica following an appeal:
"Just so you're up to date", sends Perović on June 24, 2020.
“Okay. Thanks for the information. That's what conscientious people do," Medenica answers her.
Jabučanin and Perović were wounded on November 5, 2018 in the capital, but that case was not within the jurisdiction of the court headed by Jelena Perović. The so-called manual rocket launcher. Zolja, was seized in mid-February during a search of the Cetinje's apartment Nikola Kršikapa.
From their correspondence, it can be seen that Perović initiated numerous correspondences about certain subjects, which Medenica also did in some cases.
Perović, answering a set of questions, wrote to Vijesti that she does not accept being part of the media circus:
"I do not accept to be part of the media circus and comment on alleged transcripts of messages, the authenticity of which no one has confirmed and cannot confirm, and for which there is a well-founded suspicion that they were obtained and forwarded to you in an illegal manner".
She did not specifically answer the Vijesta's questions about why she reported to Medenica from the phone number she still uses today, nor did she explain her interest in the state of the case files even after she left the Basic Court of Cetinje, but also why she passed the information on to Medenica. .
From the exchanged messages, which Vijesti has access to, it follows that Perović consulted with Medenica about the determination/revocation of custody, she apologized to her because the plea agreement in one case was not accepted...
Article 2 of the Law on Judicial Council and Judges states that the judge judges and decides independently and independently, that the judicial function may not be exercised under anyone's influence, and that no one may influence the judge in the exercise of the judicial function.
Perović also told Medenica what she talked about with the head of the Cetinje Security Department at the time Igor Popović and the mayors of the capital Aleksandar Bogdanović i Aleksandar Kascelan...
"What you are doing? Now we will receive a proposal for the detention of someone Vušurović crayons, who opened the bar today. I think he has been convicted before and it seems to me, if it turns out as they told me on the phone, that he should be sentenced. That you are up to date, and we are accepting suggestions," Perović wrote to her on March 18, 2020.
Medenica answers her briefly: "Determine".
Five days before that, Perović asked for an opinion on what to do in one case:
"You must be crowded... The police are asking me to cancel the detention of one person Jovanović Ivan, BIL, so that he would be arrested immediately at the gate for another criminal offense. That you are up to date. If the prosecutor makes a proposal, then I will cancel it. He was ordered to repeat the act, which was an attack on an official. Now this is new regarding this latest event in Cetinje. I don't know exactly for what act"...
Perović did not answer the questions about it, and the request to comment on the criticism of the former head of Cetinje and the Police Administration, due to a publicly spoken word, remained unanswered. Igor Popović...
On March 11, 2020, Perović informed Medenica that the then chief of the Cetinje police had called:
“Good afternoon, President. Let me just tell you that the head of the OB CT Popović called me and apologized for everything... That his intention was not to cause what happened... In that sense... He probably called because of you and your actions".
Medenica answers her: "Garbage... I washed the director".
"That's why he called for sure. I'll see you on Friday if there's a conference, because of the corona virus," Perović replied.
He was the police director at the time Veselin Veljović.
Previously, the head of the Cetinje police at the time, Popović, announcing the results of the Security Department, said that in the case of the discovery of a manual rocket launcher and an automatic rifle, there was no adequate reaction from the judicial authorities:
"...Those prosecuted persons were released to defend themselves in the further course of the proceedings, even though weapons were taken from members of organized criminal groups and there was a real possibility that they would be used to commit the most serious crimes"...
Three months later, Perović informed Medenica that the indictment had arrived for that case, and then she also reported to her which of the judges was in charge of confirming the indictment "for zolja", as well as who would judge the case...
“Good afternoon, President. How are you? The case of Kršikap (zolja) has been charged, the review of the indictment is ongoing".
Medenica answers her: "OK. Who judges?".
"Marija Cupic. Borko Lončar confirmation", writes the president of the Basic Court in Cetinje.
"OK, take it off," replied the then first woman of the Montenegrin judiciary and received a message from her colleague: "We have to... See you on Friday"...
Perović also informed Medenica about another case, which she did on January 27, 2020:
"What are you doing president? I hope you rested for the holidays. I forgot to tell you that they did not reach an agreement for the illegal possession of weapons. Do you remember what we heard about detention and with Onions... Sorry for burdening you during your vacation, but my days at work go by in seconds and I forgot to let you know this morning. It is scheduled for tomorrow”…
Medenica answers her: "OK. What is there is"...
"We are here for you"
Perović suggested to Medenica that the presidents of all courts call a conference for the media "in order to put an end to these attacks".
According to the transcripts, she did this on October 7, 2019.
"President, I am now reading your statement, again, regarding the sale of land and this with Boris... If you think that we should all hold a press conference, we are here. Maybe that would put an end to these attacks. So that they can see that we are not afraid and that we are here to protect the rights of citizens and ourselves, and that we are united in the fight against injustice, and that we fully support you. Whatever I can do, I'm here. Right now, I'm alternating between sadness and anger for everything, especially because I know how painful that period of your life was," writes Perović.
Medenica, however, refused her offer:
"Not even by chance. It would be orchestrated. I don't care about this," she replies.
“Okay. That is the most important thing. I got really annoyed. In the sense of how much longer", Perović writes to her.
