The state is also prosecuting Tsarević because of Krimovica

The protector of the property and legal interests of the state of Montenegro joined the criminal prosecution of the former president of the Municipality of Budva, Marko Bata Carevic, and his son, Milan, in the trial against them before the Kotor Basic Court for the usurpation of state property in the village of Krimovice in Grbalje.

This was said by Ivan Đurišić, deputy protector of property and legal interests, at the main hearing before the judge of the Basic Court, Veljko Bulatović, during the hearing.

He made a property-legal request to return the land to its original state.

Judge Bulatović has scheduled a new trial for December 20, when the geodetic expert will be heard again in order to clarify whether the cadastral plot on which the buildings of the Tsarević agricultural estate were built is located in the marine estate zone or not. Then the evidentiary proceedings would realistically end.

At the end of August last year, the Basic State Prosecutor's Office in Kotor submitted an indictment to the Basic Court against Marko Carević for the criminal offense of illegal occupation of land in Krimovica. His son Milan is charged with the criminal offense of illegal occupation of land and the criminal offense of building a building without registration and construction documentation. The indictment includes the company "Carinvest".

The Network for the Affirmation of the Non-Governmental Sector - MANS announced back in 2020 that the agricultural complex in Krimovica, which was built by the company, the family company of Tsarević, was built on half a million square meters of state land, where buildings were built without a building permit.

At the end of November 2021, the company "Carinvest" submitted a lawsuit against the state of Montenegro to the Basic Court of Kotor, requesting that it be recognized as the owner of over 620 thousand square meters of state land in Krimovica in the municipality of Kotor. In return, the company would pay 1,2 million euros, or 1,93 euros per square meter, into the state budget.

In the lawsuit, which was published by MANS, it is stated that the intention of the company "Carinvest" is to, through litigation, "acquire land that until the engagement of the plaintiff (the company "Carinvest") was completely neglected, unused and without any benefits for the state .

In the lawsuit, the Tsarevićs state that from 2015 until today, they have repeatedly addressed state institutions and local administration, trying to regulate the status of the usurped land, which they claim was "unused and forgotten by the state authorities."

Tsarević's lawsuit against Montenegro was preceded by a meeting with officials of line ministries of the 41st Government of Montenegro. According to the minutes obtained by the Research Center of MANS, on June 11, 2020, as a natural person in the Government building, Tsarević met with Milutin Simović, then Vice President for Economic Policy and Financial System, Minister of Finance Darko Radunović, and representatives of the Ministries of Agriculture and of urban planning, but also the institution of the Protection of Property and Legal Interests of Montenegro.

The minutes state that the meeting was organized on the initiative of Tsarević, and that he rejected Simović's proposal to postpone the meeting because it coincided with the holding of the session of the Municipal Assembly (SO) of Budva. On the very day he was negotiating with the then ministers, Tsarević was voted no-confidence at a session of the Budva Council of Ministers. A few days later, clashes between the then coalition led by Tsarević and the police began, during which he was arrested.
