Defendant's counsel Bratislava Dikić, lawyer Dusan Jovovic yesterday he requested that the contents of his client's confiscated phones be separated from the case file, because it is legally invalid evidence.
In the continuation of the trial for the so-called "coup d'état", he reminded the special panel of judge Zoran Radović that in the previous court process before the verdict was revoked, it was indicated that the phones "samsung" and "iphone 6" were compromised...
"The phones were taken from Dikić on October 16, 2016, at 00,05:XNUMX a.m., for which a certificate of temporarily confiscated items was issued, when they had to be sealed. In his statements, Dikić previously said that certain messages were changed and that certain messages could not have been there. The evidence collected in this way is not in accordance with the article of the CPC, it cannot be used because it represents legally invalid evidence", said the lawyer.
Addressing the court panel, Dikić stated that someone deleted data from the phone on November 8, 2016, the same day he was taken to the Special Prosecutor's Office.
"This is important to emphasize because on that very day I was taken to the Special State Prosecutor's Office, where pressure was put on me to confess my guilt. I note that I was taken to the premises of the Special State Prosecutor's Office not only during the investigation, but also during the court process. Since the trial began, I have been taken to the SDT a total of 24 times. That's when I got it Sasa Cadjenovic said that if I do not accept to say that the DF planned the attack, that Mirko Velimirović will testify as a witness. There was everything and anything. We had to endure all that and survive," Dikić said.
After an inspection of the content of the Lenovo mobile phones, seized from the witness associate Saša Sinđelić, with several thousand pages, lawyer Miroje Jovanović reacted and commented on the message.
"I especially draw attention to the message from May 27, 2015, at 00.15:38164, which reads: 'What is so important officially, so you are calling directly'. This communication was made by Sinđelić with the NN official of the MUP of Serbia +2015xxxxxxx. This is directly related to the two facts that Sinđelić falsely presented the reason why he was able to leave Moscow in May 2012, and from this he is trying to solve the red Interpol warrant from 2016. When everything is connected, it can be seen that Sinđelić in September XNUMX , could not enter the Russian Federation", said lawyer Jovanović.
Lawyer Dušan Radosavljević stated that upon Sinđelić's arrival in Montenegro, four mobile phones were taken from him, while the experts received only two for expert examination.
He claims that all of Sinđelić's phones, from which the court is now inspecting their contents, are contaminated, because it has been established beyond a doubt that they were accessed from the moment of confiscation to the time of extraction.
He concluded that the findings of the expert were legally invalid.
The trial will continue on April 24.

With the overturned verdict, the leaders of the Democratic Front (DF) Andrija Mandić and Milan Knežević were sentenced to five years in prison each, for, as the indictment states, membership in a criminal organization since February 2016.
The organizers of that Russian group, Eduard Šišmakov and Vladimir Popov, were sentenced to a total of 27 years in prison.
The former commander of the Serbian Gendarmerie Bratislav Dikić was sentenced to a single sentence of eight years, and Predrag Bogićević and Nemanja Ristić to seven years in prison.
By the same decision, Srboljub Đorđević and Milan Dušić were each sentenced to one and a half years in prison, Branka Milić to three years in prison, Dragan Maksić to one year and nine months in prison, while Kristina Hristić was given a suspended sentence.
DF driver Mihailo Čađenović was sentenced to one year and six months in prison.
The indictment states that the two Russians organized a criminal group and recruited other members for the purpose of obtaining illegal profits and power, violently overthrowing the government and declaring the electoral victory of DF and preventing Montenegro from joining the NATO alliance. The criminal organization, it is stated, planned to clash with the Montenegrin police on the day of the parliamentary elections on October 16, 2016, with the help of the Democratic Front, and forcibly occupy the Parliament of Montenegro, as well as to kidnap and kill the then Prime Minister Milo Đukanović.
