Judge of the High Court Suzana Mugoša before the Disciplinary Council, before which she is responsible for claims that the judgment of the Court of Appeal in the "Coup d'état" case was bought, she said that the assets of the judge of the Court of Appeal Seke Piletić who wrote the second-instance judgment does not correspond to her income. She added that she only expressed her doubt that the decision of the Court of Appeal was made with possible corruption.
Mugoša pointed out that on this occasion she gave a statement at the Special Prosecutor's Office, so she did not want to answer the question when she became convinced that the judgment of the Court of Appeal was bought.
She denied the serious disciplinary offense she was charged with, that she behaved inappropriately in a public place by expressing her opinion on an ongoing case.
"I was at home, not in a public place when I made a statement to journalists, so I did not behave inappropriately for the function of a judge. I did not even express an opinion on the case or the outcome of the proceedings, but on the accusations that are personal discrediting and that has been going on for seven years," she said. Mugosha.
"That was my value judgement, which was necessary," said Mugoša.
Mugoša said that she could not cross the red line that she was corrupt and that it would be unethical to remain silent on the allegations of the Speaker of the Parliament Andrije Mandić that her first-instance verdict was bought, which is why she reacted publicly for the first time.
This, he says, was to protect her integrity, explaining that Judge Piletić misrepresented the facts from her first-instance verdict and based certain conclusions on that.
In her defense, Mugoša said that she would not have even announced publicly if the Appellate Court had acquitted the defendants, but instead sent the case back to the Higher Court, to which there is no right of appeal, while exempting it from further proceedings without explanation.
The judge of the High Court explained in detail to the members of the Disciplinary Council what, in her opinion, are the illogicalities in the judgment of the Court of Appeal, and what makes it untrue and illegal.
Disciplinary prosecutor Diana Radulović answered that Mugoša did not provide any evidence that the judgment of the Court of Appeal was bought or forged. She added that Mugoša is available 24 hours a day, that she made a statement to the media in that capacity, and that there is no justification for being at home.
The President of the Disciplinary Council is a member of the Judicial Council from among distinguished lawyers Fikret Kurgas, judge of the Court of Appeal and member of the Judicial Council Predrag Tabas and a judge of the Bjelo Polje High Court and a member of the Council Sanja Konatar.
Disciplinary prosecutor Dijana Radulović filed the indictment, accusing Mugoš of having committed a serious disciplinary offense by stating that she also believes that the judgment of the Court of Appeal in the "Coup d'etat" case was bought.
The disciplinary prosecutor proposes a half-yearly salary reduction of 30 percent as a punishment, due to the fact that she publicly commented on a verdict that is not legally binding.
Let us remind you that in November of last year, Mugoša stated that she is convinced that the decision of the Appellate Court in the "Coup d'état" case was bought and that it is a forgery of an official document.
"I said that a year ago, because the judge who wrote the second-instance decision inaccurately and untruthfully quoted words and parts from the first-instance verdict with the obvious intention of changing the essence," she pointed out.
Mugoša then reacted to the statements of NSD and DNP leaders Andrija Mandić and Milan Knežević, in which they pointed out that it is necessary to find out if there is communication between her and Vesna Medenica in connection with the verdict in the "Coup d'etat" case.
