Miloš Medenica offered about 1,4 million euros in real estate to the High Court in Podgorica, as a pledge that he would regularly respond to their calls and would not sabotage the proceedings in which he is accused of forming a criminal organization that ordered court decisions and smuggled cigarettes.
The court's public relations advisor, Marija Raković, told Vijestima that the properties that Medenica guarantees that he will not escape during the court proceedings are owned by his relatives.
Miloš Medenica was arrested on May 25, 2022, at the Podgorica airport, after entering Montenegro from Serbia.
The Special State Prosecutor's Office (SDT) filed an indictment against Miloš and his mother Vesna Medenica, Darko Lalović, Vasilij Petrović, Bojan and Marko Popović, Milica Vlahović Milosavljević, Marko Vučinić, Milorad Medenica, Luka Bakoč, Petar Milutinović, Ivana Kovačević, Radomir Raičević, Marjan Bevenja, Steve Karanikić, Goran Jovanović and "Kopad Company" from Nikšić...
They are charged with criminal offenses - the creation of a criminal organization. extended criminal offense of smuggling, extended criminal offense of giving a bribe, receiving a bribe, illegal influence and inducing illegal influence, abuse of official position, unauthorized production, possession and distribution of narcotic drugs, facilitating the consumption of narcotic drugs, illegal possession of weapons and explosive substances, serious bodily injury and prevention of evidence.
Miloš Medenica's defense attorney, lawyer Stefan Jovanović, told Vijesti that they submitted a proposal to the court to determine bail in the total amount of EUR 1.450.000,00:
"Which consists in the constitution of a mortgage in favor of the state of Montenegro on immovable properties that have been owned by the Medenica and Vlahović families for several decades, while in this particular case it is about immovable properties that are not under financial investigation and for which documentation is attached, from which the indisputable origin arises" , he said.
He explained that in this way they respected the position of the High Court and the Court of Appeals, related to the previous proposal on the guarantee, and regarding the property that is under financial investigation and the amount of the offered guarantee.
"Miloš Medenica is the only accused from the specific proceedings who is in custody, since the detention of the other accused persons was lawfully terminated with the simultaneous imposition of supervision measures. The defense believes that the time period that has passed since the moment of detention, and the amount of bail offered, represent a sufficient guarantee that the presence of the accused will be ensured, i.e. that the proceedings will be conducted unhindered, while everything mentioned above indicates that there is no legally prescribed difference between the accused Miloš Medenica and the other accused who are defending themselves at liberty," said Jovanović.
The lawyer points out that the offered bail corresponds with the position of the Constitutional Court, when it comes to the further duration of custody of the accused Medenica, but also with the practice of the European Court of Human Rights.
