The Court of Appeal ordered the exclusion of the testimony of the inspector from the case of drug sales in Berane

The retrial of Jovan Milanović (39) from Podgorica and Aleksandr Ilić (27) from Beran for the criminal offense of unauthorized production, possession and distribution of narcotic drugs was not held today in the High Court in Bijelo Polje.

The hearing of the co-perpetrators was postponed after the High Court, acting on the annulment decision of the Alepaci Court, made a decision to extract from the case file the statements of the police officers of the OB Berana, Darko Mališić and Boško Vlahović, about their operational knowledge regarding the alleged sale and purchase of drugs.

In an earlier verdict, Milanović was sentenced to three years and six months in prison for the accusation that he sold 0,114 grams of heroin to Beranc Ilić, while Ilić was sentenced to six months in prison - because he sold part of that drug to a fellow citizen of BV

That verdict was annulled by the Court of Appeal, which accepted the appeals of the defendants and their defense attorneys Kasim Dizdarevic and Goran Radić, stating, among other things, that the court's decision cannot be based on operational findings.

They explain that the first-instance verdict cannot be based on the testimony of witnesses Mališić and Vlahović, in the part where they present certain operational information that "the defendant Ilić possesses narcotics intended for sale to Bojan Vukićević, who was supposed to come to Ilić's apartment."

According to the indictment, Milanović sold 7 grams of heroin to Ilić on June 2022, 0,114, in Polimska Street in Berane, in front of the entrance to the building where he lives. According to the previous agreement with Ilić, he came to his building in a Range Rover vehicle. After getting into the vehicle, he handed Ilić the drugs for an unspecified amount of money.

Ilić sold 0,65 grams of that drug on the same day in the same place to a fellow citizen, Bojan Vukićević, for the amount of 10 euros.

Milanović was convicted several times for other and similar crimes, while Ilić was not convicted.

As stated in the indictment, the drug was found by police officers in the basement of Vukićević's house while he was preparing it for use, while the remaining amount was found in the toilet of Ilić, who, when the police arrived, spilled the drug into the toilet bowl in an attempt to throw it away. from myself.

Milanović denied that he sold drugs to anyone, while Ilić admitted that he sold Vukićević some of the drugs he bought from a man, because he is an addict, admitting that he lied during the investigation that he did not sell him drugs.

After the separation decision becomes final, the trial will continue on March 13.
