Father of the deceased Sheila Bakija he was recording with his phone Ilir Đokaj just before he killed his nineteen-year-old daughter, it was stated yesterday in the Podgorica High Court.
Đokaj before the Council of Judges Veljko Radovanović in the Podgorica High Court is responsible for the murder of his unmarried wife and the wounding of her father Shabana.
In the evidentiary proceedings, two video-audio recordings recorded by Šaban Bakija's phone were reviewed, and the conversation took place on the terrace of the family home.
"The court, upon direct inspection of the audio-video, stated that the recording was from the phone of the injured witness Šaban Bakija. That the phone was in his lap. That the now-deceased Šejla Bakija and the accused Ilir Đokaj, who did not have facial injuries in this video, can be seen occasionally on the video. The court states that at the end of the video, after the injured witness Šaban Bakija says: 'Let go mother, don't push him, but let him alone and let's take it easy. Ai Šeki, you're on your way', you can hear the repeating of the gun, then the shots are heard. After which the court states that the deceased Šejla falls on the floor of the terrace. After that, the injured witness Šaban Bakija can be seen on the video, who has an injury and blood can be seen in the shoulder area", Judge Radovanović stated in the minutes after watching the video.
State prosecutor Ana Radovic in the Higher State Prosecutor's Office, after watching this video, she stated: "A video speaks more than a thousand words".
Not long after, the defendant fell ill in the courtroom, after which a break was given.
He was quickly taken out of the courtroom and taken to the Emergency Center to be treated. After the assistance, Đokaj was brought to the court, and then the trial continued.
In the continuation of the evidentiary proceedings, the report of the psychiatric expert was read - the Commission of Medical Examiners stated that the defendant does not have a psychological or mental illness, and that he is a dominant narcissistic personality and emphasized that this is not an illness, but part of his character and that it does not reduce his sanity.
During the evidentiary proceedings, two videos were viewed, the first of about thirty seconds, and the second of half an hour, in which the accused Ilir Đokaj's conversations with Šaban Bakija and his daughter Šejla were recorded.
Šaban Bakija told Šeila several times that they are not defending anything and that she can go with Ilira if she wants and if she loves him, after which she repeats several times that she doesn't want anything to do with him and that she doesn't know why he doesn't understand that.
At the very end of that conversation, gunshots and gunshots are heard repeating.
Attorney of the injured family Bakija, lawyer Tijana Zivkovic, she said that the video shown completely refutes the defendant's defense.
"It can be concluded that the last words of the now deceased Sheila Baki were: 'Will you leave me alone, it's the hardest for me,'" said the lawyer. She added that it was crown evidence and that the defense had been refuted.
"Religion was not mentioned, although the defendant stated that reason that led to this serious murder. I believe that the watched video is the crown evidence that will be decisive for the court's decision," said Živković.
No excuses...
Defendant Đokaj's defense attorney, lawyer Srđan Lješković, said that 30 minutes of head down and silence in response to insults against the accused's family and his religion led to the tragedy.
He added that he is not trying to justify the accused.
In the video shown, Šaban Bakija can be heard saying, among other things: "For God's sake, no one ever forbade her to leave the house." She wanted to leave the country because of you. I gave the apartment and told you, I don't want to hear about the fight... We are really at the end of our nerves because of what he is doing". Then he added, addressing Đokaj: "You called me yourself and said, here it is, we are no longer together."
Šejla Bakija then says: "He won't stop, he will spin again". Her father Šaban Bakija says: "The fact that you are breaking into our house, that you are threatening her, those are threats that she will not be with anyone but you, that she should not have anyone, that's what you wrote... those are threats".
Lješković told the court that out of respect and the pain the family experienced, he did not ask who said the following words to Đokaj:
"All Malaysia laughs with you at what you do; They will tell us tomorrow that we gave it to a madman again; You don't live with crazy people, should I kill this fool; Come on, become a Turk, can you make yourself a Turk; I would rather give it to a Serb from Zeta than to you"...
