The former inspector general of the National Security Agency (ANB) Artan Kurti will file a criminal complaint against Prime Minister Milojko Spajić for today's appointment of the new inspector general Predrag Burić, which he claims is illegal.

In his statement to "Vijesti", Kurti said that Burić was only subjected to a security check, and as he claims, he does not meet other conditions prescribed by the amendments to the Law on ANB.

"According to the amendments to the Law on ANB, Article 40, he must pass the conditions from Article 27a of the Law on ANB. He was neither psychologically tested, nor did he pass other acts in the ANB. Therefore, with the new amendments to the Law on ANB, which was amended only to Kurti would not return, the conditions from Article 27a are required for the appointment, that he fulfills the same conditions for appointment as for the ANB official and plus five years of experience," Kurti said.

He explained that no one is accepted for employment in the Agency unless they first pass a psychological test and procedures, i.e. acts of the ANB.

Commenting on the fact that Burić was appointed before the decision of the Administrative Court before which Kurti initiated proceedings against the Government, he says that this was done in order to pre-empt the court's decision to illegally dismiss him.

"However, when the Administrative Court cancels the decision on the dismissal, Article 56 of the Law on Administrative Disputes is applied, the case is returned to the state it was in before the dismissal, so that in the case of annulment of the decision, the amendments to the Law on ANB are not valid, but the regulation is applied at the moment of the appointment and will have to act according to the verdict and return him to the position of general inspector", stated Kurti.

He announces that he will file a criminal complaint against Spajić.

"How legal the Government's decision about my dismissal is is shown by the fact that the explanation states that my mandate ends because the mandate of the 43rd Government of Montenegro has ended, which is not true considering that I was appointed for a five-year mandate. Well, according to that logic then the mandate of the director of the Agency should have ended, because he was also appointed to the mandate of the 43rd Government, so in that case I will also file a criminal complaint for illegal dismissal," Kurti said.
