The correspondence of the former president of the Supreme Court, Vesna Medenica, shows that she directly influenced the prosecution and the courts to file indictments and judge according to her directives, why did she receive orders from the top of the government and DPS.
This was stated by the defense of the accused Duško Knežević, after Vijesti published a part of Medenica's telephone communication with the current President of the High Court, Boris Savić, in which the accused businessman is mentioned.
"Based on the correspondence found in the phone of the former first lady of the Montenegrin judiciary, which was taken from her after Medenica was arrested (and, according to the indictment of the Special State Prosecutor's Office, a suspect) on suspicion of abusing her official position and being part of a criminal group formed by her son Miloš Medenica, arrested due to connections with the drug cartel, it can be seen that the president of the Supreme Court directly influenced the prosecution and the courts to file indictments and judge according to her directives, why did she receive orders from the top of the government and the DPS," states the statement that signed by lawyer Zdravko Đukanović.
They note that their correspondence from 2019 and 2020 proves their illegal interest in the investigation against Knežević, but also clearly shows the direct connection between the chief special prosecutor Milivoj Katnić, the special prosecutors who agreed to act on his order and the then executive authorities of the DPS on led by Milo Đukanović.
"The implementation of the court process against the president of the Atlas group, Duško Knežević - these correspondences confirmed, was controlled by the first woman of the Montenegrin judiciary, Vesna Medenica, who, contrary to the Constitution of Montenegro, was entrusted with the third term of the president of the Supreme Court. Is the procedure justified, even though there should be two parties in the proceedings, that the special state prosecutor Stojanka Radović reports to the President of the Supreme Court about the court cases, and especially about the proceedings against Duško Knežević, even though Vesna Medenica took a keen interest in the prosecutors and judges who were in charge of this case".
They state that the correspondence that Medenica exchanged with Zoran Pažin, the Minister of Justice from the ranks of the DPS, is particularly indicative: "Minister Pažin sent a message to the President of the Supreme Court on April 18, 2019, inquiring about the reasons for postponing the hearing to confirm the indictment against... Knežević and the executive director of Atlas bank Đorđe Đurđić, with a warning to Vesna Medenica that - 'do not warn without reason'... The President of the Supreme Court informed the Minister of Justice with a message dated May 13: 'Indictment confirmed. Written dispatch tomorrow'".
Due to the statement of the Minister of Justice and DPS officials that "he does not warn without reason", they add, it is not difficult to conclude who ordered the indictment against Knežević.
"From the content of these conversations, it is clear that the prosecutorial and judicial authorities in Montenegro in the case of Duško Knežević, as well as in other cases that at that time occupied a special place and special attention of the Montenegrin public, primarily the case of a 'coup d'état', acted exclusively according to orders of the executive authority. It is clear that the Appellate Panel of the Interpol Appeals Commission had this in mind when it made the decision in August 2020 to cancel the warrants in relation to Duško Knežević. The fact that the president of the High Court in Podgorica, Boris Savić, is still on this function indicates that there was no serious and relevant reform in the Montenegrin judiciary at all. No serious trials can be conducted nor can any fair procedure be expected while this system is current, while Boris Savić and the persons who continue to act on his orders in key positions in the most important court in Montenegro, the High Court in Podgorica".
They state that the way of functioning, the way of communication and inappropriate vocabulary clearly indicate the fact that there were no institutions in Montenegro, and there are no institutions, but there are influential individuals who are trying to keep their positions, which they are succeeding in for now.
"Proceedings against Duško Knežević are, in fact, standing for the reason that it is obvious that the persons who filed the indictments ordered by the executive power, led by Milo Đukanović, are still bright and dressed in the High Court in Podgorica. Such practice must be urgently legal way to disable".
