The trial of the accused criminal group Stefan Đukić and Emil Tuzović, who were accused by the Special State Prosecutor's Office of preparing the murders of judges, prosecutors and police officials, continued in the High Court in Podgorica today.
The defendant, Milan Brajović, pointed out that communication with the Sky application is not reliable evidence, and then clarified. Speaking about why it should be excluded from the case file, today he presented to the court a scheme thanks to which the judges who judge can very easily become like him, that is, find themselves in a situation where they are accused.
"And you, honorable judges, for 300 euros, tomorrow you can be accused like us", claims the accused Brajović.
He reminded the position of the defendants' defense that Sky is operational data and that this information was obtained by a hacker attack on a server located in France and that the judicial authorities there approved the hacking order targeting a group in Belgium and a group in France.
The defendant Brajović explained that the order was designed in such a way that all the data downloaded from the server in France by the company "Elektron" would be transferred to the hard disk and then distributed to the states via Europol.
"But when ignorance is combined with bad intentions and political influence, then the Sky app as you see it as evidence becomes a weapon in the hands of all of us. In a conversation with the French prosecutors through an intermediary, I received an explanation that Sky represents a weapon with the help of which anyone can end up behind bars," claims Brajović.
He believes that four people on any social application create fake accounts with the names of prosecutors, judges or politicians with their pictures. Then it starts with communications between these fake profiles, where they write about life, work, social events in Montenegro in their messages, but send messages to each other that indicate a criminal offense.
"I remind you that the life of a judge is public because his trials and verdicts are available to the public. After a certain time, the judges will send a report about a terrorist attack on France from the fake profile, after which the authorities of that country will forward that information to our police," said the accused Brajović.
"Does it mean that you are that profile. So they are asking you to judge us," said Brajović, trying to explain to the court how he got to the dock. He added that the order of the court in France ordered that all private messages should be destroyed and based on the criminal offense, but in a way to monitor whether the suspect, like me for example, has a phone, whether I am following and meeting with someone. However, our prosecution misused the Sky application, all in order to gain illegal fame and results in connection with chapters 23 and 24", concluded the accused Brajović.
At the previous main hearing, the defense attorney of the defendant Haris Tuzović, lawyer Damir Lekić, suggested that the evidence stemming from the "SKY" communications should be excluded from the case file. He pointed out that this evidence is legally invalid. He pointed to a practice that is already known in Serbia, which refers to the fact that the prosecutor must establish the identities of the persons who allegedly used SKY. In addition to Emil Tuzović and Stefan Đukić, Zoran Perović, Dušan Dudić, Milan Brajović, Nino Korać, Stefan Mićić, Aleksandar Raičević, Dušan Boljević, Albin R. Salić, Branko D. Pejanović, Haris Tuzović, Goran Milašinović and Bojan G. were also accused. Lopicic.
In the decision of the Court of Appeal, it was stated that the defendants are reasonably suspected of having committed the criminal acts charged against them by the indictment of the Special State Prosecutor's Office of Montenegro, i.e. that in the course of 2020 and beyond, the defendants Stefan Đukić and Emil Tuzović, together with others by a so far unidentified person, created a criminal organization whose goal is to use violence and intimidation, and at the same time it is planned to influence the political, executive, legislative and judicial authorities in the operation of the criminal organization.
"The defendant Emil Tuzović determined for himself and in agreement with the defendant Đukić that he plans in the future to commit the criminal acts for which the criminal organization was created, that through other members of the criminal organization he recruits persons to become members of the criminal organization, that he incites the members of the criminal organization to commit crimes crimes against life and body to the detriment of holders of judicial functions in Montenegro - judges and prosecutors, in order to delay criminal proceedings and avoid the responsibility of members of a criminal organization for the crimes for which they are accused. Then to coordinate preparatory actions, monitor the holders of judicial functions, plan and determine the time and place of attacks on holders of judicial functions in Montenegro, with the aim of inflicting serious physical injuries on judges and depriving the lives of special prosecutors and police officers, in charge of solving serious crimes that was carried out by the criminal organization. The defendant Zoran Perović to act according to the orders and instructions of the organizer of the criminal organization of the defendant Stefan Đukić, to establish communication with the holders of the highest state positions in the executive branch, to offer them money and other benefits in exchange for the holder's influence, using his previous acquaintance and his real and assumed influence executive authorities on the dismissal and election of holders of judicial functions - judges and prosecutors, who would deliver acquittals in court proceedings against the organizers and members of the criminal organization for crimes of aggravated murder and other crimes committed in an organized manner. By offering at least one million euros to the holders of public functions of the executive power to dismiss the Chief Special Prosecutor Milivoj Katnić and the Special Prosecutor Saša Čađenović, who initiated, led and filed charges against the organizers of the criminal organization," states the decision of the Court of Appeal.
