The prosecutor is still considering bail for Mijajlovic

The proposal has been in the prosecutor's office for seven or eight days, and the action he needs to complete can last 10 minutes, says one of his defense attorneys, lawyer Zoran Piperović.

The High Court has not yet decided whether it will Aleksandar Mijajlovic on bail to defend from freedom the accusation that he formed a criminal organization that smuggled cigarettes.

This is what one of his defenders, a lawyer, told "Vijesta". Zoran Piperović, emphasizing that the opinion of the special prosecutor is awaited.

On March 22, Mijajlović's defense guaranteed the court with 1,1 million euros that the man from Podgorica would be available to them if his detention was lifted.

"Until Friday, by 15 p.m., the court did not receive the opinion of the special prosecutor Miroslav Turković in which he would declare whether he agrees that the court should accept the bail offered by me and my colleague Stefan Jovanovic. This means that the proposal has been in the prosecutor's office for seven or eight days, and the action that needs to be completed can take 10 or five minutes," Piperović said.

He assessed that this, however, was a smaller problem than the one they faced.

"We have a bigger problem - at the moment when detention is ordered, the judge Suzana Mugoša stated in the explanation of the decision on custody that there are no communications on the Sky application between Aleksandar Mijajlović and any person, probably thinking that the prosecution has it and that it is a matter of days when it will emerge in the case. Today we have the following fact, which is simply incredible, and most of all illegal. Mijajlovic has been in detention for more than 30 days, and the prosecution has, as I have information, sent a request to France a few days ago, asking questions to Europol - whether there is any communication on Skye between Mijajlovic and any person. And I ask - what should Mijajlović do until then and what should Mijajlović's defense do until then? So we have Mijajlovic in custody without the elementary and only evidence in that case, which is Sky communication. "We have a citizen of Montenegro who is waiting for the prosecution to find evidence to verify his previous detention," claimed Piperović.

He states that "it hasn't happened yet, and it shouldn't happen" and that Mijajlovic "should be released from custody immediately".

"And it would be even better if the special prosecutor now opposes the setting of bail by the High Court, so that this would be completely wrong".

Mijajlović was arrested on February 19 by order of the Special State Prosecutor's Office (SDT), which accuses him of forming a criminal group that smuggled cigarettes with another person.

The members of Mijajlović's criminal team were labeled police officers by the SDT Milenko Mića Rabrenović, Radoje Rabrenović, Dragan Backović i Mirko Mijušković, then Dejan Jokić, Golub Vojinović, Milan Vukadinović and several persons whose identification the prosecutors are working on.

After the arrest, "Vijesti" was told that in the files of the SDT, which manages the case, it is written that the members of that organized group smuggled cigarettes internationally for at least three years - from 2019 to the end of 2021.

"Mijajlović and another person, according to the available evidence, created that organization in 2019," claims the newspaper's interlocutor.

According to that information, correspondence from the encrypted Sky phone application, in which, according to the investigators, the arrested participated, is said to be among the data forwarded from Europol. Some of their lawyers denied the claims.

A months-long action by the SDT resulted in the arrest, as insiders claim, of the very top of the so-called Grand clan, with Aleksandar Aco Mijajlović at its head.

In addition to the second organizer, according to "Vijesti" information, investigators are looking for several other persons who participated in that illegal business, and who are now listed as unknown persons in the prosecutor's files.
