The trial of the Turkish citizen Binali Çamgoz was postponed today in the Podgorica Basic Court until May 13.
Čamgoz's defense attorney, lawyer Marko Radović, today asked for the exemption of the Basic State Prosecutor's Office (ODT) in Podgorica from acting in the case that was formed based on the indictment proposal of that state prosecutor's office against his client, due to the extended criminal offense - inducing to certify untrue content.
"In the proposal for exemption from the proceedings of the Basic State Prosecutor's Office in Podgorica, it is stated that this proceeding was initiated by the prosecution against a Turkish citizen of BC based on the evidence it had in the case that was already legally concluded before the Basic Court in Podgorica, due to the criminal offense of forgery documents," said that court.
"As a request for exemption from the proceedings of the Basic State Prosecutor's Office in Podgorica was submitted by the defendant's counsel, it was necessary to submit the said request to the competent prosecutor's office for decision-making, which is why the procedural prerequisites for holding the main trial were not met," the statement concludes.
Before submitting the application for exemption, submitted a complaint about the work of the ODT
Before submitting the request for exemption, we addressed the Prosecutor's Council with a complaint about the work of the ODT in Podgorica, said Radović.
He stated that they repeated the arguments that, as he said, they presented in the request for exemption.
"We are talking about the arguments we put forward when the Basic Court in Podgorica, that is, the investigating judge of that court, was deciding on the proposal of the Basic State Prosecutor's Office to order detention in relation to our client, when he also rejected that proposal," he added.
He said that not long after, as he said, the Minister of Justice refused to extradite Camgoz to Turkey, the ODT initiated a new procedure, and that they believe, as he stated, that the ODT's actions create great uncertainty.
"My client, along with his passport and identity card, was then deprived of a temporary residence permit in Montenegro. Camgoz himself pointed out that he used those falsified documents to obtain a temporary residence permit. If the prosecution had done something about it then, that action entered into the construction for which he was accused," said Radović
He assessed that this reaction of the defense was necessary, "the same situation could happen tomorrow, so we want to use these legal means to protect ourselves from all that."
