The Special State Prosecutor's Office (SDT) dismissed the criminal complaint Marko Milačić against the special prosecutor Sanje Jovicević, which he submitted due to the fact that he had not yet processed it on September 17, 2021 Zoran Lazović because he is accused of Belgrade criminals Great Belivuk i Marko Miljković enabled entry into Montenegro.
The leader of Prava Montenegro almost three years ago reported that police official, and since his report did not result in the deprivation of freedom of the former security guard, he accused the special prosecutor of creating a criminal organization and abuse of official position.
The SDT, however, states that Jovićević made a reasoned decision based on the available evidence and the fact that her colleague at the time Sasa Cadjenovic did not submit all relevant data. Čađenović was arrested in December 2022.
They explain that Jovićcević, in order to verify Milačić's allegations, asked Čađenović in a written act to see the case files formed as a result of the police's criminal report against Belivuk, Miljković, Nebojša Jankovića i Ratko Živković...
"It appears that the special prosecutor Saša Čađenović, without any accompanying formal act, apparently delivered only part of the case file to her... which is in agreement with the testimony of Sanja Jovićević in the case of the investigation against Saša Čađenović. Upon inspection of the copy of the criminal complaint in question, it follows that it was filed against Veljko Belivuk, Marko Miljković, Nebojša Janković and Ratko Živković for the criminal offenses of creating a criminal organization... and aggravated murder by aiding and abetting... and that the integral part of the copy of the criminal complaint was communications that Veljko Belivuk and Marko Miljković carried out through the encrypted application SKY ECC with other members of the criminal organization, immediately after the murders of Damir Hodžić and Adis Spahić and exclusively on the occasion of that event".
They state that it is therefore necessary to point out that the evidence for the initiation of criminal proceedings against the suspect Lazović on April 14, 2024 was gathered through a later analysis of communications made through the encrypted SKY ECC application, which the prosecutor Jovićević did not have at the time of the decision to dismiss the criminal complaint...
"In the opinion of this prosecutor's office, the content of the SDT case file does not provide sufficient grounds for making a conclusion about the existence of a well-founded suspicion that the reported ... as acting special prosecutor in that case committed the criminal offenses charged against her, nor any other criminal offense within the substantive jurisdiction of the Special State Prosecutor's Office, as well as any criminal offense for which it is prosecuted ex officio. On the contrary, it was established that Sanja Jovićevic, in charge of the case, continuously undertook evidentiary actions that she... judged to be necessary in order to make a decision on the criminal complaint of Marko Milačić dated September 17.09.2021, XNUMX. years".
Milačić's second application
Lazović and the former chief special prosecutor Milivoje Katnic they were arrested only recently, among other things, on the suspicion that they helped those citizens of Belgrade to enter the country unhindered...
This was done based on the second application by Milačić, which he submitted on March 30, 2023, after the change in the leadership of the SDT, and on which the special prosecutor worked Miloš Šoškić.
"By checking the official records of the Special State Prosecutor's Office, it was established that according to the criminal report of Marko Milačić dated March 30.03.2023, 14.04.2024. year, a new criminal case was formed... which is in charge of the special prosecutor Miloš Šoškić, whose work on the case was completed on April XNUMX, XNUMX. resulted in the deprivation of liberty of Zoran Lazović and former chief special prosecutor Milivoj Katnić".
Informing Milačić about the outcome of the report against the prosecutor, the SDT chronologically explains that Milačić first requested the arrest of the former assistant director of the Police Administration for the Sector for the fight against organized crime and corruption, due to the well-founded suspicion that he had committed the criminal offense of creating a criminal organization, and that the acting prosecutor "rejected his criminal complaint as unfounded without any substantial and legally valid reason"...
"Given that her direct superior at that time was Chief Special Prosecutor Milivoje Katnić, after the change in the leadership of the Special State Prosecutor's Office and numerous new facts about the criminal activities of certain prosecutors and police inspectors, he again submitted an identical criminal complaint against Zoran Lazović because of his participation in lifting the ban on entry into Montenegro for Veljko Belivuk and Marko Miljković, which directly resulted in the murder of several persons".
In the application, it was stated that in the light of the latest events, namely the arrest of Lazović and Katnić, Milačić has reasonable suspicions that Jovićević was and is a member of that criminal organization.
"In which she had the role of protecting the perpetrators of criminal acts within that criminal organization from criminal prosecution by failing to fulfill her legal duty and illegally using her official position and authority."
Inspection of files
In the SDT's decision to dismiss the complaint against their prosecutor, it is explained that Milacić's data did not provide sufficient grounds for issuing an order to conduct an investigation, nor a decision to dismiss the criminal complaint, which is why they reviewed the case files.
It follows from them that they were formed on September 17, 2021, following the application of the then deputy Milačić, and in which it was written that on January 28, 2021, Lazović stated at a press conference that there was no need to fear the presence of Serbian citizens Belivuk and Mijković in to Montenegro, as he also said at the same time: "If they are not enemies of Montenegro, there is no need to fear anyone... Belivuk and Miljković will be under the surveillance of the Sector for the fight against crime 24 hours a day, and of course we will try to prevent criminal activities"...
It is also stated that on August 18, 2021, the SDT announced that the Police Directorate filed a criminal complaint against Belivuk, Miljković, Nebojša Jankovića i Ratko Živković, because of the suspicion that they killed Barane Damir Hodžić i Adis Spahić...
"It follows from the criminal report of the police that it is clear that Zoran Lazović's statements from January 28.01.2021, XNUMX, regarding the fact that there is no need to fear the presence of Serbian citizens Belivuk and Miljković in Montenegro, were incorrect and planned in order to enable their entry into Montenegro for criminal activities and the commission of criminal acts and that Zoran Lazović, due to the function he performed, must have had clear knowledge that these are persons who have committed and will commit criminal acts on the territory of Montenegro".
It is stated that it was established that the prosecutor Jovićević, on the basis of legal powers, undertook the evidentiary actions that she deemed necessary after the investigation and issued a reasoned decision on the rejection of the criminal complaint, as well as the criminal complaint of the MUP, in relation to the officers of the Police Administration, Slavka Ivanišević, Aleksandar Bošković. and Saša Đurović, as well as in relation to Enis Baković, former assistant director of the Police Administration.
"With the assessment that there is no reasonable suspicion that the accused have committed the criminal offenses charged against them, nor any other criminal offense for which they are being prosecuted ex officio".
