The defense attorney of the two defendants, Milan Janković and Milan Milović, lawyer Nikola Ivanović, confirmed the information to Vijesta that by the decision of the Higher Court in Podgorica, the indictment based on the communications made through the encrypted application ANOM was returned to the special prosecutors.
He explained that this was exactly what he pointed out to the council before which the merits of those accusations were discussed.
"Exactly what I pointed out during the indictment review hearing, which is, among other things, the absence of an order or any other documentation of the alleged third country, as well as the identity of that third country, was accepted and respected by the panel of the High Court. In support of such claims, the practice of German regional courts in identical cases was submitted," said Ivanovic.
He explained that the High Court in Podgorica ordered that the investigation needs to be supplemented:
"However, bearing in mind that this kind of data has never been delivered to anyone, not even to Germany, it is completely justified to expect that it will not be possible to act on the orders from the decision," he said.
