By the decision of the High Court in Bijelo Polje, fifty-four-year-old police officer DL, accused of illicit sexual acts committed against a minor, was returned to custody.
This was answered by the Higher State Prosecutor's Office in Bijelo Polje to "Vijesti", explaining that the Higher Court decided again after the Appellate Court, accepting the appeal, revoked their decision.
"The higher state prosecutor's office in Bijelo Polje received the decision of the Court of Appeal, which was made on the appeal of this prosecutor's office. The Appellate Court of Montenegro annulled the decision of the High Court, which terminated the custody of the defendant DL from Š., due to the criminal offense of illicit sexual activity to the detriment of a minor, and returned the case to the High Court for retrial and decision. According to the decision of the High Court in Bijelo Polje dated May 15, 05, the defendant DL was ordered to be detained," spokeswoman for the Bijelo Polje Prosecutor's Office Ljubica Caković told "Vijesta".
"Vijesti" announced on May 15 that the detention of the fifty-four-year-old man was terminated after the indictment was confirmed and that the Bjelopolje prosecutor's office appealed against that decision.
That officer was arrested in mid-January after the family of his 13-year-old neighbor reported that he tried to assault her.
On April 8, the Bjelopolje Prosecutor's Office submitted an indictment against him to the High Court there, and then they also submitted a proposal for the extension of custody:
"Due to the criminal offense of illicit sexual acts, committed to the detriment of a minor. By the decision of the High Court in Bijelo Polje, the indictment of this prosecution was confirmed on April 24, 4, and the main hearing was scheduled for June 2024, 10," explained Caković at the time.
In those answers, she pointed out that on April 30, the extrajudicial panel of the High Court in Bijelo Polje terminated the custody of the accused:
"On which decision did the acting state prosecutor file an appeal to the Appellate Court of Montenegro within the legal deadline, and on which appeal has this prosecution not yet received a decision," Caković replied on May 14.
Police officer DL was arrested on January 15 on suspicion that the night before, in a town in the north of Montenegro, he tried to assault a minor neighbor.
According to "Vijesti" information, when the girl was passing by his house, he invited her to watch the game with his children, and then tried to assault her.
"Vijesti" then announced that the girl contacted her parents, telling them that she was going to watch the game with the children from the neighborhood and went to their house, and not long after that she ran into the house and told them what happened.
“DL was home alone and immediately started groping her and tried to kiss her. She pushed him away and ran home," the "Vijesti" interlocutor said at the time.
On the same day, the Police Directorate officially confirmed the information to "Vijesti" about the arrest of their officer, explaining that fifty-four-year-old DL was handcuffed on suspicion of having committed the crime of illicit sexual activity against a 13-year-old girl.
"The police officers acted on the report and undertook activities within their jurisdiction in cooperation with the acting senior state prosecutor and deprived DL of his liberty for the above-mentioned criminal offense, which, as is suspected, he committed on January 14 in his apartment," they said at the time UP.
