The High Court in Podgorica has once again closed the trial of the former head of the National Security Agency (ANB) to the public. Dejan Perunicic and the official of that institution Srđa Pavićević, after three cases were consolidated against them for illegal wiretapping and monitoring of citizens.
Judge Igor Djurickovic he decided so in order to preserve the secret and public order, which was warned by the defense attorneys of the accused.
Lawyers Zdravko Begović i Predrag Đolevic they previously pointed out that this is a specific situation, given that it is about former managers of ANB and that there is classified information in the case.
Peruničić is accused of having organized the monitoring and eavesdropping of several political, then opposition leaders, journalists, clerics, journalists, as well as the former chief special prosecutor. Milivoj Katnić.
"I propose that the public be excluded for the entire course of the proceedings, bearing in mind the specificity of this case, in which the accused, when presenting their defense, would have to present certain information that constitutes a secret, and due to its nature, if made public, could threaten the general and public interest and the security of state services in in connection with their functioning", said lawyer Begović.
Defendant Pavićević's lawyer, lawyer Predrag Đolević, agreed with lawyer Begović's proposal, adding that the case contains information that has the character of a state secret.
Special prosecutor Nataša Bošković left the defense's proposal to exclude the public to the court for evaluation.
Peruničić is accused of having on several occasions given oral orders to Pavićević to follow and observe the aforementioned several persons in the area of Podgorica, Budva and Cetinje, using technical means for photo-documentation, without a previously issued written order.
Pavićević is accused of coordinating those activities on the order of Peruničić and participating in them himself, without a previously issued written order for monitoring and observation, even though he knew and was obliged to know that this was contrary to Article 11 of the Law on ANB.
