In the High Court in Podgorica, a hearing was held today to review the indictment against members of the criminal organization of the defendant Radoj Zvicer and the other defendants for the murder of Damir Hodzic and Adis Spahic.
One of the defendants is Veljko Belivuk, known as Velja Nebula, who via a video link from Belgrade, before the Podgorica High Court, said that Montenegro does not respect the European Court of Justice when it comes to the invalidity of "SKY".
"I expected much smarter things to hear from the prosecutor today. I agree with the lawyers that no matter what we say, the indictment will be upheld. We have more cases than all of you down here put together. This indictment lacks sufficient evidence. As for the special state of the Prosecutor's Office of Montenegro, the indictment is for the section "believe it or not", Belivuk said.
He added that the fact that the SDT refers to international legal aid and the French court in order to justify the validity of "SKY" as evidence, asked whether the prosecutor represents the Constitution and Law of Montenegro or France.
"I don't know where the prosecutor took the oath and whether he is French, so he thinks he is in Paris and not in Podgorica," Belivuk said.
Belivuk said, among other things, that the indictment states that a certain Neno Kaluđerović is charged with advising how to set someone on fire with tires.
"The law of physics does not allow something to be set on fire, disappear, and then be buried, as stated in the indictment," Belivuk believes.
He added that the indictment states that he personally kills Hodžić, and then the accusations show that he is nothing, but "an ordinary holder".
"And all of us will be nothing until the end of the proceedings", assessed Belivuk.
On the allegations in the indictment that he, Miljković and Janković illegally entered Montenegro, he concluded that "the prosecution has no idea where they were".
"SDT states that Damir Hodžić was banned from entering Montenegro due to some procedure. And how was he killed there? Is there an official confirmation that he was there at the time in question," Belivuk asked.
He also referred to the findings of medical expert Nemanja Radojević, disputing the fact that based on a photograph, he made an expert opinion on whether someone was dead or alive.
"Then I have a fear that Hollywood actors will be 'killed' in Montenegro after some time," Belivuk said, disputing the findings of the expert.
He said there was no autopsy, no DNA findings, no victims, and no body.
He added that the special prosecution does not have a single proof that Radoje Zvicer organized and formed this alleged criminal group.
Miljković: Hodžić is somewhere alive and well and smiling
Accused Marko Miljković said that he agreed with everything Belivuk said.
"You are arresting the people who allegedly transported us to Montenegro. And you see, the SDT has not found who brought Hodžić, and they will not find it," according to the defendant Miljković.
He addressed those present in the courtroom with the words: "Hodžić is alive and well somewhere, and he is laughing at you and us."
"Regarding the accusation that a certain Neno Kaluđerović advised how to set someone on fire with tires, me and Belivuk accuse each other of having set someone on fire in 2019. So, if that's the case, what will Kaluđerović do to me, if I know about it from 2019," said Miljković.
Serbian citizens Marko Miljković, Veljko Belivuk and Nebojša Janković were also accused in this proceeding, by the indictment of the Special State Prosecutor's Office of Montenegro.
The indictment stated that Zvicer ordered the kidnapping of Hodžić and Spahić at the end of July 2020 because he believed that they, as close associates of the previously murdered Alan Kožar, knew where the latter hid money and drugs.
"Radoje Zvicer, as the organizer, between the end of July and the second half of August 2020, ordered the defendants Radoje Živković, Milan Vujotić, Dragan Knežević, Marko Miljković and Veljko Belivuk to find each other and kidnap them at a suitable opportunity, and then in an insidious manner , out of reckless revenge, base motives - intolerance and hatred and in order to establish supremacy, took the lives of members of the opposing criminal organization, Mile Radulović and Damir Hodžić," the indictment states.
In addition to Zvicer, Živković, Vujotić, Knežević, Miljković and Belivuk, there are also Marko Miljković, Ratko Živković, Nebojša Janković, Stevan Kraljević, Slobodan Kašćelan, Nenad Kaluđerović, Darko Prelević, Davor Perović, Blagoje Gašić, Dejan Gašić, Nikša Perović, Miloš Radonjić, Vladimir Vučković, Petar Đurović, Rade Garović, Mersudin Čolaković, Marko Kilibarda, Aleksandar Paunović, Nikola Spasojević, Radovan Mujović, Milan Knežević, Aleksandar Dragićević, Zoran Kažić, Aleksandar Ljumović, Borko and Bojan Bešović.
Vučinić: Sky obtained in a legal way; lawyer Vuksanović: The defense knows that the indictment will be confirmed
Special State Prosecutor Zoran Vučinić said today at the inspection of the indictment that the SDT has collected enough evidence to confirm this indictment and added that "SKY" was obtained in a legal manner.
Contrary to the position of the prosecution, all the accused denied the allegations of the indictment and stated that they agreed with the lawyers who contested the "SKY" evidence.
Lawyer Miloš Vuksanović said that it was known in advance that every "SKY" indictment would be confirmed. He stated that the High Court as an institution is hostage to uncritical behavior towards the SDT.
"About this indictment, in terms of evidence of the "SKY" material, I think the worst. But confirm it, because we are aware that the fate of this hearing is not in the hands of the court. We are simulating the equality of "weapons" here. Where there is "SKY" evidence, these hearings should be boycotted , because our word is not heard. And we know that this indictment will be confirmed", said lawyer Vuksanović.
