President of the Court for Misdemeanors in Bielopolska Alija Beganović announced to "Vijesti" that two days later the request to initiate misdemeanor proceedings against Lekić was submitted to that court in regular, and not in emergency, proceedings.
"Since there is no judge in the Pljevlja division, due to the retirement of the existing one, and a new one has not yet been chosen by the Judicial Council, regular cases from the Pljevlja division are delegated to other court divisions and judges for handling. During June, cases were delegated to the Mojkovac division and the case was delegated on June 6.06.2024, XNUMX," said Beganović in his reply.
He clarified that this is a case that was sent in a regular procedure, and not in an urgent procedure, bearing in mind the number of cases in which each judge acts - the decision has not yet been made.

The court for misdemeanors in Bijelo Polje announced on the day when Lekić was deprived of his liberty for the offense of driving a vehicle under the influence of alcohol.

They explained that the judge on duty was neither informed of Lekić's deprivation of liberty that night nor did he order the defendant's release.
"This was already done by the police officers after the doctor's report and examination of the defendant. The court is not interested in the name and surname of the defendant or any other attribute or affiliation, but only the perpetrator of the offense and the court will act on every request, whether it is submitted in an emergency or regular procedure. Actions before notifying the judge on duty or before submitting a request are not within the jurisdiction of the court," they stated at the time.
The Law on Road Traffic Safety in Article 296 paragraph 1 stipulates that an authorized police officer, in accordance with the law regulating misdemeanors, may deprive a driver, young driver, novice driver or driving instructor of their freedom if the presence of alcohol in the body in a higher concentration has been determined of 1 g/kg.
Due to the fact that Lekić was released, after the doctor's report, the Police Directorate launched an internal check on whether the officers of the Pljeval police acted legally because the first man of the "Coal Mine" did not spend the night in the "concrete mixer" due to drunken driving.
