"The reaction of the injured party's attorney, lawyer Vladimir Janković from Podgorica, regarding the decision of the investigating judge of the Basic Court in Podgorica that the suspects MM (62), DM (22), DH (21) and L.Č. (29) defend themselves in the further course of the proceedings On July 13.07.2024, 62, the suspects MM (22), DH (22) and L.Č , sent a series of insults and threats on national and religious grounds to the victims NL (21), AT (29), MJ (53) and JK (48), and then attacked them physically, giving them dozens of blows, on which occasion they some of the victims suffered serious physical injuries, which was confirmed by medical reports.

What makes the whole situation even more difficult is the fact that this act of mindless violence took place in front of twelve children who were accompanying the injured. So, in concrete terms, it was not about a "mass brawl", as some media reported, but about the unprovoked, wanton violence of the suspects against the victims, who are first and foremost family members, but also distinguished citizens, who represent the state of Montenegro and its cultural heritage on numerous international events, promoting, among other things, multi-ethnic harmony.

After the victims called the police, the suspects moved away from the scene, and then continued their violent behavior in the capital city of Podgorica, in the Konik settlement, where, according to the Police Administration, the suspect PM (22) tried to take his life with a dagger one face. Thanks to the quick reaction of the Police Administration, all the suspects were deprived of their liberty, and the next day they were taken to the prosecutor on duty, who ordered their detention after the hearing, and submitted a proposal for detention to the competent court. The decision of the investigating judge of the Basic Court in Podgorica that the suspects MM (62), DM (22), DH (21) and L.Č. (29) does not order detention, we regard it as worrying.

First of all, such a court decision sends a very wrong message to the public that violence, even the most brutal, should be tolerated. In addition, what is more important, we appreciate that the grounds for detention under Art. 175 st. 1 point. 2 and 3 of the Code of Criminal Procedure, i.e. that there is a justified fear that the suspects at large could influence witnesses or repeat violence, which further endangers the safety of the injured.

Therefore, we believe that the decision of the judge for the investigation of the Basic Court in Podgorica is illegal, and that it does not take into account the seriousness of the criminal offense that the suspects are charged with, nor the consequences that the victims suffered. On this occasion, we appeal to the panel of the Basic Court in Podgorica to look at all the facts and circumstances of this case that point to the exact opposite conclusion from the one reached by the investigating judge, especially the fact that some of the suspects, according to our knowledge, are going through the records due to criminal acts with elements of violence.

Therefore, in our opinion, in this case there are circumstances for ordering custody, the primary purpose of which is to prevent the suspects from repeating the criminal offense in the further course of the proceedings, and possibly committing the criminal offenses with which they threatened the injured parties, and in what way in the further course of the proceedings ensured the safety of the injured, who do not want to live in fear of further attacks by suspects".
