The Special State Prosecutor's Office submitted an immediate indictment against Petar Mujović to the Special Department for Trials of Criminal Offenses of Organized Crime, Corruption, Terrorism and War Crimes of the High Court in Podgorica, for the criminal offense of aggravated attempted murder, committed as an accomplice, to the detriment of the now deceased Jovan Vukotić.
The SDT explained that the indictment was filed due to the existence of a well-founded suspicion that the defendant, as a member of the criminal organization of the defendant Radoj Zvicer, was carrying out the criminal plan of that Kotor resident and the defendants Slobodan Kašćelan and Milan Vujotić "out of reckless revenge, base motives - intolerance and hatred and for establishing the supremacy of their criminal organization, on October 21, 2020, in Kotor, tried to take the life of one of the organizers of the opposing criminal organization, injured JV".
They state that he did this by waiting for him, armed with a pistol with a mechanically destroyed factory number, with 15 bullets and a bullet in the barrel, ready to be fired, in front of the building of the Police Department of the Kotor Security Department, in order to take his life at an opportune moment, when he was brought from by police officers, but he was prevented from completing the criminal act because the police officers deprived him of his liberty.
"The defendant was found guilty by the final verdict of the Basic Court in Kotor, due to the same life event, of the criminal offense of illegal possession of weapons and explosive substances and was sentenced to five months in prison, and he was sentenced to a security measure of confiscation of the item - a pistol as a means of committing a criminal offense acts, while in relation to the organizer of the criminal organization of the defendant RZ and members - the defendants SK and MV, as co-perpetrators of the criminal offense, in the procedure of checking the justification and legality of the indictment of the Special State Prosecutor's Office, the criminal proceedings were illegally suspended in that part, by the decisions of the Higher Court in Podgorica, Kvso no. 32/23 and the Appellate Court of Montenegro Kvsž no. 329/23, dated October 9 and November 22 last year, and the Supreme Court of Montenegro, by judgment Kzz no. 1/2024, dated July 2 this year , adopted the request for the protection of the legality of the Supreme State Prosecutor's Office of Montenegro and determined that the decisions of the Higher and Appellate Courts violated the law in favor of the defendants," SDT announced.
They explained that Mujović is in custody at the Administration for the Execution of Criminal Sanctions in another criminal case.
Earlier, the SDT filed an indictment against the head of the Kavak clan, Radoj Zvicer, and his associates Kašćelan, Vujotć, Ljubo Milović, Petar Lazović, Radoj Živković, NS, DR, Radovan Mujović, NP and RP, due to the attempted murder of the leader of the Škaljar clan.
"Against whom indictments have already been brought by this prosecution, for the criminal offense of creating a criminal organization and other criminal offenses and which have been confirmed and entered into legal force".
