The decision to extradite Binali Camgoz is the first such decision made in the history of Montenegro, regardless of the fact that the Minister of Justice tried to find a foothold in some other decision made earlier. It is an understatement to say that it is scandalous, said one of his defense attorneys, lawyer Marko Radović.
He explained that Minister Bojan Božović referred to a decision made in Italy, which is not applicable in this case.
"We filed a criminal complaint against Minister Božović, and it is possible that we will file against some other persons," said Radović.
He and Miloš Vuksanović, otherwise the defenders of a citizen of Turkey who was recently extradited to that country, submitted a criminal complaint to the Special State Prosecutor's Office.
As indicated, they organized a press conference to point out illegalities in the extradition process.
Radović said that despite everything they have seen since representing Camgoz, they could not believe that Božović would make such a decision, because he is entering the zone of criminal responsibility.
He called Minister Božović's actions a legal scandal, adding that it is not about ignorance, but the intention to extradite Camgoz "after all" to Turkey.
He said that, considering the information that Camgoz represents a threat to national security, and without going into the accuracy of that assessment, they expected that Turkish citizen to be expelled from Montenegro, but not extradited to Turkey.
The lawyer said that such decisions and the people who are ready to make them pose a greater danger to Montenegro.
"In December, the Administrative Court decided on our second claim for asylum. Due to the pressure, it was expected that this decision would be rejected... At that time, we as defense attorneys, seeing the direction things were going, submitted a proposal to the European Court of Human Rights for the issuance of a temporary measure "This was done by our colleague and friend Bojana Franović. They told her that the conditions had not been met... but that if a decision was made on extradition, she should submit the decision immediately, in order to issue a temporary measure," said Radović.
He claims that the letter was immediately delivered to the ECtHR by the Ministry of Justice and the Police Directorate, who ignored it and extradited Camgoz an hour after the extradition decision was made.
The lawyer said that they submitted all these files to the SDT.
"Everything we do cannot have the effect of returning him from Turkey, but we want responsibility to be determined, because such decisions create legal uncertainty," said Radović.
Lawyer Vuksanović said that this case is extremely important for the legal system of Montenegro.
"Camgoz is in Turkey and we can no longer help him, but after the scandalous decision of Minister Božović, we cannot accept that anyone should be treated in this way. Nor that Minister Božović willingly, by his own admission under the suggestions of certain security structures, made this decision... The criminal complaint was submitted today to the SDT, which is the only one competent for these criminal acts," said Vuksanović.
He said that he was in a dilemma whether to talk about it before, but because of this difficult case, he wants to say that Camgoz was very deliberately portrayed as a person who threatens the security of the state.
"Camgoz was kidnapped. It is a classic kidnapping directed by state authorities," the lawyer pointed out.
"There is no greater interest than respecting justice. This is a serious precedent, the consequences of which will be seen very soon in the future," he said.
Vuksanović said that it is scandalous that the Minister of Justice deals with operational data in the decision, which was not supported by anything.
Camgoz was heard in the capacity of a citizen and categorically denied that he threatened Minister Maras Dukaj, his defense attorneys answered the question of Vijesti.
On the day Camgoz was extradited, the police "ran into" the house where he was staying and informed the family members that there was a sniper near the house and that his life was in danger, said Vuksanovic, adding that this was a prelude to the kidnapping.
Vuksanović said that he could not get information even on the spot, and that even after the conference was announced, he got a hint from the media that Camgoz was "thrown to the lions in Turkey" and that in an illegal way.
Vukasnović: I will resign from membership in the Prosecutor's Council
Vuksanović announced that tomorrow at the latest, he will resign from membership in the Prosecutor's Council, in order to relax the prosecutor who will handle the case.
Vuksanović said that he wanted to erase all doubts so that the prosecutor would solve the criminal-legal matter very seriously, without any indirect or direct pressure.
"It was an honor for me to be part of the Prosecutor's Council, but I think we must be principled to the end," he said.
