The Council of the Appellate Court, following a complaint by the Special State Prosecutor's Office (SDT), revoked the decision of the High Court in Podgorica which terminated the detention of the former director of the Police Directorate (UP) Veselin Veljović this summer.
This was confirmed for "Vijesti" by the independent advisor for public relations of the High Court in Podgorica, Marija Raković.
She announced that by the decision of the Appellate Court, the case regarding Veljović's detention was sent back to the Higher Court in Podgorica for re-decision.
On July 20 of this year, the Special State Prosecutor's Office filed an appeal to the Court of Appeal against the decision of the panel of the judge of the Special Department of the High Court in Podgorica, Vesna Kovačević, who on July 18, after almost a year, released the accused, the former director of the Police Directorate, from custody.
The Council of the High Court then adopted the proposal of Veljović's defense attorneys Danilo Mićović, Nikola Martinović and Mihailo Volkov and imposed a surveillance measure on him - a ban on leaving the apartment, with electronic monitoring.
Veljović's lawyers requested the cancellation of the detention, claiming that there is no basis from Article 175 paragraph 1 point 1 of the CPC, stating that the detention lasts too long, especially if you take into account the health condition of the accused former police chief.
SDT prosecutors Vukas Radonjić and Jovan Vukotić opposed that proposal, claiming that there are still reasons why the detention was ordered and repeatedly extended by the extrajudicial panel.
One of the accused did not come to the trial that day due to illness, and medical expert Nemanja Radojević was called and waited in the corridor of the High Court.
The council allowed the expert witness Radojević to conduct an expert opinion on the medical condition of the defendant Veljović based on the medical documentation.
"The court had in mind the findings and opinion of forensic medicine expert Radojević Nemanja, who, by order of this court, performed an expert examination of the medical documentation at the main trial, and found that the health condition of the accused Veselin Veljović is permanently severely impaired, so in this regard the court is of the opinion that the presence of the accused and the smooth conduct of the criminal proceedings will be ensured by means of supervision. Because the accused Veselin Veljović is in such a serious state of health, which has worsened over the past year, the court is of the opinion that he will not flee." , it is written in the decision of the council.
Veljović, it is stated in the decision of the council referring to the indictment, was accused that in December 2020, before his dismissal in the UP, and then after moving to the position of adviser to the then president Milo Đukanović, through SKY communication, he gave an official secret to the fugitive organizer of the group, Aleksandar Mrkić, that the police will also search the apartment of group member Mujo Nikočević...

SDT also established that Nikočević told defendant Mrkić via SKY phone, after the search, that the police would find a firearm on him and that he would be arrested for that.
