The Court of Appeal sentenced Arsenij Stanović to 15 maximum years in prison for the murder of Ukrainian citizen Anastasia Lashmanova on May 11, 2018.
That court accepted the appeal of the Higher State Prosecutor's Office in Podgorica and overturned the verdict of the Higher Court in Podgorica from March 19, by which Stanović was found guilty of the criminal offense of murder and sentenced to 12 years in prison, to which the time spent in custody since June 17, 2018.
"Against this verdict, the Higher State Prosecutor's Office in Podgorica filed an appeal with the proposal that the Court of Appeal of Montenegro change the verdict of the Higher Court in Podgorica by convicting the accused Stanović of the criminal offense of aggravated murder and sentence him to the punishment prescribed for that criminal offense, adequate to the gravity of the crime committed. of the act and the degree of his guilt," the Court of Appeal announced.
According to that court's assessment, the first-instance court "did not commit significant violations of the provisions of the criminal procedure and violations of the Criminal Code that are pointed out in the appeal, nor other violations of the provisions of the criminal procedure that this court takes into account ex officio".
"However, the Appellate Court is of the opinion that the first-instance court did not properly assess the punishment of the accused for the committed criminal offense and did not sufficiently appreciate the aggravating circumstances that exist on the part of the accused, which are reflected in the fact that the accused showed perseverance by inflicting a large number of stabs and blows and persistence in the commission of the criminal offense, as well as the actions he undertook after the commission of the criminal offense in order to conceal it. For these reasons, the Court of Appeal changed the imposed prison sentence of 12 years to the maximum prison sentence for this criminal offense of 15 years. , appreciating that the imposed sentence is proportional to the severity of the committed criminal act and the degree of guilt of the accused and that the purpose of punishment will be achieved with such a measured sentence, i.e. that the sentence imposed in this way will influence the accused, but also others, not to commit criminal acts in the future," he states. in the announcement.
