Podgorica NM he called his ex-girlfriend MJ to visit a friend in a tavern in Međurječe, but the dinner ended in violence - he hit her in the head with his fists and phone, pulled her hair, threatened to throw her into Morača near Bioč and kill her family.
The victim told the prosecutor that she was in an emotional relationship with the defendant four years ago, but they broke up due to irreconcilable differences. Nevertheless, on September 17, they agreed to visit a friend R. Š. in a tavern in Međurječje.
According to her, the violence started shortly after they arrived, around 21.30:XNUMX p.m., when NM took the phone and hit her on the head, then pulled her hair.
"...N. started with some stories 'where are your brothers now' and very soon after they sat down, he took the phone, hit her in the head with it and pulled her hair. She was uncomfortable because R. and some other girls were there. He also mentioned her ex-boyfriend, friends and family. She contacted one of her friends and wrote in a message that she needed help. After this, N. punched him several times in the area of the head and body, as well as with an open fist in the area of the face. Defending herself, she suffered a hematoma in the shoulder and thigh area. After hitting, N. continued to sit calmly and eat dinner", the judges interpret her statement given before the prosecutor.
Telling the prosecutor that she survived, she also recalled that R. Š. saw her injuries and heard that she was crying, but that the defendant was hitting while their friend was preparing fish in the kitchen.
She also said that while she was in the toilet, her ex-partner grabbed her neck with his hand, threatening her: "Don't let me drown you".
She also told the prosecutor that after that she asked her ex-partner to drive her home, but he threatened her while they were going to Podgorica.
"Near Bioč, he threatened to throw her away from Bioč (in Morač, author's note), and maybe him as well because it is best not to live."
She also said that she was trying to find some help, so she sent a message to her daughter-in-law, after which she called NM and asked him to stop:
"After which he insulted her: 'Now I'm going to clean up that slut,' threatening to kill her entire family. She asked him to leave her a little further from the house so that her parents would not see her, however they found her halfway from the place where N. left her. She had fainting spells and after that she was given medical help," her testimony is quoted in the court files...
NM was arrested for violence against his ex-partner, and by the decision of the investigating judge of the Basic Court in Kolašin, he was detained for up to 30 days.
The panel of the High Court in Bijelo Polje, which rejected the appeal of NM's defense and the request to terminate his detention, also believes that there is a danger that he would repeat the crime if he is released.
"Examining ex officio the correctness and legality of the challenged decision, the panel of the High Court in Bijelo Polje finds that detention is a necessary measure for the time being, and that the purpose for which detention was ordered could not be achieved with measures milder than detention," state the judges of that court - Milan Smolović, Milan Rajkovic i Dragan Dasic.
"The investigating judge correctly finds that the extension of custody is justified and based on the law, and that there are circumstances that indicate that the defendant, bearing in mind the factual situation in the case files, could repeat the criminal offense. Bearing in mind that there is a well-founded suspicion that the defendant, on critical occasions, on several occasions, hit the victim, pulled her hair, squeezed her neck, pushed and threatened her, and after that incident he threatened her that he would 'throw her off Bioč', and that it is obvious that the defendant and the injured party are in a disturbed relationship, according to the finding of this panel, the said facts represent special circumstances, which indicate a real danger that the defendant will repeat the criminal act", state the judges.
Admitted to hitting twice
The defendant told the prosecutor that he and MJ had been in an emotional relationship for about a month, that they had gone to a tavern in Međurječje to have dinner, and he admitted that he had hit him twice. "
They sat in the tavern, probably for two hours, and consumed alcohol. At one point, his girlfriend, M., started behaving abnormally and cursing him, his mother, as well as threatening him. This irritated him and he once hit him in the forehead area with a mobile phone, and another time in the face area with an open fist. After that, she got up and went to the toilet to wash herself, when he heard and saw that she fell on the tiles," he said before the prosecutor...
