Supreme State Prosecutor Milorad Marković rejected the lawyer's request Damir Lekić, the defense attorney Brand i Bojan Popović, for the exemption of the chief special prosecutor Vladimira Novovićand in the case against Vesne Medenica and others. Also, the lawyer's requests were rejected Miloš Vuksanović, the defense attorney Marko Vučinić, To Miroj Jovanović, the defense attorney Marjana Bevenje, for the exemption of special prosecutors Vukas Radonjić i Jovan Vukotić.
The lawyers submitted the requests at the hearing on September 19, 2024, claiming that the prosecutors are endangering the rights of all the accused, including Vučinić and Raičević.
Marković explained that Novović did not act in that case, and that Radonjić and Vukotić worked in accordance with the law.
"And that there is no reason for their exemption", it says in the explanation.
Lekić contested the decision, claiming that the prosecutors' exemption is possible if there is doubt about their impartiality:
"The exemption of the head of the state prosecution in this case of the chief special prosecutor can be requested if one of the parties points out that there is doubt about his impartiality, bearing in mind his relationship with the state prosecutor whose request for exemption should be decided or his relationship with one of parties and the like", said Lekić to Vijesti.
"It is really surprising and worrying the actions of the Supreme State Prosecutor in the said decision, since even the chief special prosecutor himself did not refer to this circumstance in his written statement highlighted in that decision that he does not act in that case. Although, if it was legal and had logic and reason, he would certainly have done it, but he already declared himself in a completely different way," he added.
Lekić also asked whether VDT is "trying to create some new practice" or "something completely different is behind it".
