One of the leaders of the Kavac clan Slobodan Kascelan he was arrested yesterday at the gates of the Spuška prison, which he was supposed to leave because the legal deadline for passing a first-instance verdict in the case for the murder of a man from Podgorica had passed. Nikola Stanišić, in August 2020.
He was handcuffed at the gate of the Administration for the Execution of Criminal Sanctions (UIKS) in Spuz, by order of the Special State Prosecutor's Office (SDT), which in the meantime prosecuted him for several serious crimes.
The authorities did not clarify why the man from Kotor was again deprived of his liberty, that is, for which specific criminal offense, out of the several with which he is accused. According to "Vijesti" unofficial information, he was returned to custody on charges of triple murder.
Advisor for public relations of the High Court in Podgorica Marija Raković yesterday before noon, she told "Vijesta" that Kašćelan's detention was terminated.
Article 179 of the Law on Criminal Procedure stipulates that, after the submission of the indictment to the court, until the end of the main trial, custody may, in the opinion obtained by the state prosecutor, when the proceedings are conducted on his charge, be determined or terminated only by the decision of the panel and that from the filing of the indictment to of the first-instance verdict, custody can last for a maximum of three years.
The custody of Kašćelan, his bodyguard, ended yesterday precisely because of the failure to issue a first-instance verdict Vladimir Vučković i Kotoraninu Zoran Kazić.
Both of them were arrested by order of special prosecutors.
Kašćelan, Vučković and Kažić were arrested on April 23, 2021 in Kotor, on suspicion of being part of a criminal organization responsible for the murder of Stanišić, who was liquidated in an insidious manner.
It was the second time in less than 80 hours that the police handcuffed Kašćelan and his associates, and that night the police force headed to Kotor after the panel of the High Court overturned the judge's decision Miroslav Bašović, who only a few hours earlier had released the leader of the bar and the five arrested to defend themselves.
That night, the police did not find the three members of the clan arrested in the initial operation on April 21 of that year - Miloš Radonjić, Baptism of Maroš i Darko Prelević.
For the murder of Stanišić, the Special State Prosecutor's Office charges Kašćelan, Vučković, Kažić, Radonjić, Maroš, Prelević, Radoja Zvicer, from Nikšić Radoje Živković called Yellow and from Podgorica Milan Vujotić, then Bjelopoljec Srdja Jurisevic, Kotorane Dragana i Milan Knežević, from Podgorica Aleksandar Dragićević i Zdravko Perunović from Nikšić.
The indictment for that crime was confirmed in October 2022.
In the meantime, Kašćelan was also prosecuted for the murders of the skalars Damir Hodžić, and his son-in-law Adis Spahić who did not have a criminal record, as well as for the kidnapping and then the liquidation of one of the leaders of the bar cell of the criminal Skaljar clan Milo Radulović called Captain.
The prosecution charges Kašćelan, Radoj Zvicer and 29 members of their criminal organization with triple murder.
The prosecutors claim that they are members of that criminal organization and Milan Vujotić, Nenad Neno Kaluđerović, Veljko Belivuk, Marko Miljkovic, Stevan Kraljevic, Vladimir Vuckovic, Ratko Zivkovic, Nebojsa Jankovic, Darko Prelevic, Darko Perovic, Marko Kilibarda, Aleksandar Paunović, Milan Knezevic, Aleksandar Dragićević, Zoran Kažić, Aleksandar Ljumović, Radoje Zivkovic, Dragan Knežević, Blagoje Gasic, Dejan Gasic, Niksa Perovic, Miloš Radonjić, Petar Đurović, Rade Garovic, Mersudin Čalakovic, Nikola Spasojevic, Radovan Mujović, Borko Besovic i Bojan Besovic.
The SDT filed an indictment against Kašćelan and 17 other people for planning the liquidation of the leader of the rival Škaljar clan. Jovan Vukotić, as well as a member of this clan Jovan Jovanovic.
In addition to Kašćelan, 17 other people were charged, including Radoje Zvicer and Milan Vujotić.
However, that indictment was not accepted by two chambers - the criminal extrajudicial High Court in Podgorica, but also the Court of Appeal.
This summer, the panel of the Supreme Court made a decision that they illegally determined that there was no place for the accusations of the Special State Prosecutor's Office when they suspended the proceedings against the accused leaders of the Kavac clan, Radoj Zvicer, Slobodan Kašćelan and Milan Vujotić, for the attempted murder of the former head of the Skaljar clan, Jovan Vukotić.
After the Supreme Court adopted the request for the protection of the legality of the Supreme State Prosecutor's Office of Montenegro and found that the decisions of the Higher and Appellate Courts violated the law in favor of the defendants - the SDT submitted an indictment against Petar Mujović at the beginning of September for the accusation that, on the order of Zvicer and the plan of Kašćelan and Vujotić tried to kill Vukotić in October 2021.
Kašćelan has been on trial in the High Court in Podgorica for years for being with Igor Božović at the end of May 2010, he organized a criminal group whose members engaged in drug smuggling, extortion, money laundering, and bribery. Included in the indictment are: Vladimir Bozovic, Miloš Radonjić, Siniša Vlahović, Aleksandar Djurišić, Igor Djurišić, Davor Prelevic, Stefan Brnović, Aleksandra Bogdanović, Đerđ Camaj, Zlatko Samardzic i Ilija Dedović.
