After two years of proceedings, the Basic Court in Kotor issued a verdict in the "Krimovica" case, which unequivocally indicates the extent to which the Montenegrin judiciary is still trapped and how, despite numerous evidences, it is still difficult to get justice in Montenegro, it was assessed from Networks for Affirmation of the Non-Governmental Sector (MANS).
"Marko Carević and his company 'Carinvest' have been usurping close to half a million square meters of state-owned land in Krimovica in the municipality of Kotor for almost a decade, during which time they illegally built over 6.000 m2 of business space on that location. The fact that the former head of the Municipality of Budva, was acquitted shows that the Basic Court in Kotor completely ignored the fact that Marko Tsarević was the head of the company 'Carinvest' until 2021 and that the usurpation and illegal construction started in 2015, and it was the elder Tsarević who played a crucial role in carrying out that of a criminal act," according to the MANS announcement.
They add that the Kotor basic court convicted only Milan Carevic for usurpation, who only appears as the formal owner of the company in 2021.
"Such neglect of commonly known and easily verifiable facts points to the suspicion that, for the time being, the non-final verdict was not brought as a result of ignorance, but rather an attempt to protect individual interests that. Also, the awarded amount of 100 thousand euros is shameful and represents only part of the damage that the state During the multi-year usurpation, Montenegro had close to half a million square meters in Krimovica".
MANS called on the acting prosecutor to file an appeal against this verdict of the Basic Court of Kotor without delay.
"Both when it comes to the acquittal of the elder Tsarević, as well as the amount of the sentence and the fact that during the entire duration of the court proceedings he used the property for which he was accused of usurping unhindered. We also expect that, now that the usurpation has been proven before the competent court, the state authorities will take all necessary measures to return half a million square meters in Krimovica to state ownership," concludes the MANS announcement.
