This was decided by the panel of the High Court in Podgorica, which confirmed the indictment of the Special State Prosecutor's Office (SST) filed against that criminal group, charging them with the creation of a criminal organization and 11 criminal offenses of unauthorized production, possession and distribution of narcotic drugs.
SDT announced that on October 29, the panel of the High Court in Podgorica confirmed their indictment filed on June 24.
"Which the Special State Prosecutor's Office brought against six defendants (MB, ZK, NN, RV, NB and ZD), for the criminal offense of creating a criminal organization and 11 criminal offenses of unauthorized production, possession and distribution of narcotic drugs.
The Council, among other things, confirming the indictment, stated that the now decrypted communication from the SKY ECC application is legal evidence, obtained "by applying the substantive and procedural provisions of the law of the Republic of France" and based on the orders of "the investigating judge of several French courts", "and the compliance those provisions with the constitution of France, especially with regard to the protection of the right to privacy and the right to defense in criminal proceedings, was examined by the Constitutional Council of that country," the SDT announced.
They explained that the council specifically further stated that: "...in the decision of the Constitutional Council of the Republic of France No. 2022-987 QPC dated 08.04.2022/XNUMX/XNUMX, it was stated that the actions of the French state authorities in the mentioned part were in accordance with the Constitution of that country, that according to the system of mutual recognition, the countries of the European Union do not examine the content of the evidence obtained by the competent authority of the member state, and in the opinion of this court there are no obstacles for the courts in Montenegro to accept the evidence obtained in this way, since it does not contradict either the principles of the domestic legal system and the generally accepted rules of international law. This is especially so given the fact that in this specific case the Republic of France did not undertake investigative actions and collect evidence at the request of Montenegro, when Montenegro could set certain requirements regarding the method of collecting evidence and applying certain procedural rules. rules, it has already submitted, at the request of Montenegro, the evidence that it already had in its possession and that it had previously obtained in accordance with its legislation".
The six persons against whom the indictment was confirmed are charged with, as members of a criminal organization, carrying out a criminal plan, smuggling 150 kilograms (kg) of cocaine and 59 kg of methamphetamine, by sea, from Belgium to near Australia, in the period from September to December 2020. .
Milovan Burić is also charged with the criminal offense of unauthorized production, possession and distribution of narcotic drugs, due to smuggling for the sale of 380 kilograms of cocaine, by sea, across the North Sea to Sweden, in May 2020.
"The defendants MB and ZK are charged with the same criminal offense for smuggling for the purpose of selling 1.834 kg of cocaine, by sea, from South America to Spain, in the period from the end of January to the second half of February 2021," SDT announced earlier. .
After the indictment was filed, they also said that Burić and Brkan were charged with smuggling 199 kg of cocaine, by sea, from Belgium to near Australia, in the period from the end of January to mid-March 2021.
