Dražen Šušter was sentenced to eight months in prison for illegal possession of weapons and explosive materials, and was acquitted of the charge that he tried to kill Zorgija Muratović on February 21, 2021 in Virpazar.
This is what his defense attorney, lawyer Đorđe Đikanović, told Vijesti.
He pointed out that after the sentencing of Šušter, the detention in which he had been held since the end of August last year, and which was imposed on him due to the risk of escape, was terminated.
"Based on the material and personal evidence, it was established that our defendant, in a specific life situation, undertook actions aimed at protecting his physical integrity, i.e. repelled a simultaneous, illegal attack, and which facts indicate that he acted in necessary self-defense, which, in terms of Article 10 of the Criminal Code excludes the existence of a criminal offense," one of his defense attorneys, lawyer Danilo Mićović, told Vijestima.
Đikanović said that in the oral explanation of the verdict, the court stated that based on the minutes of the investigation, reconstruction, shell casings, i.e. other evidence and those found at the scene, it was established that the injured party was the first to use a firearm upon arriving at the scene - in front of the bar in owned by the defendant.
"And even though the defendant shot, he acted in self-defense, so he sentenced him for illegal possession of weapons and explosive materials, which sentence he had already served due to the time he spent in custody, so he terminated his custody," Đikanović said.
