Today, a hearing was held in the High Court in Podgorica, where the justification and legality of the indictment against Haris Kočan and Vanja Burda, for the murder of Radovan Marković and aggravated attempted murder against Nikola Drecun and Igor Mašanović, were checked.
Lawyer Branko Anđelić said that on November 2024, XNUMX, the defendant Vanja Burda submitted a plea agreement proposal to the prosecution. However, as lawyer Anđelić said, the prosecutor is probably waiting for the indictment to be confirmed first.
Lawyer Anđelić said that the defendant Haris Kočan told him that it is proposed to exclude the record of his interrogation from the file. He added that Kočan showed the injuries he received from police officers in the prosecution.
"He confessed to a criminal offense for which he was not questioned and which he did not commit. It was already clear that there was torture. He showed the injuries to the prosecutor Ana Kalezić and said that he gave his testimony under pressure," said lawyer Anđelić regarding the testimony of the accused Kočan, which refers to the attack on Drecun and Mašanović.
Lawyer Anđelić then added that as far as the murder of Radovan Marković is concerned, all the evidence indicates that it was a negligent homicide. He added that it is not normal for the accused to go to help Marković, that it is not normal that he was with him all the time after he was wounded, if, as the prosecution claims, he intended to kill him, which the defense disputes and claims that this is not the case but that it is murder out of negligence.
Lawyer Anđelić said that if such a statement of the defense was accepted, after that Haris Kocan would also go to the proposal of entering into a plea agreement.
The accused Haris Kočan said that he admitted his guilt for the criminal offense in relation to the now deceased Radovan Marković. He added that with regard to his statement that he gave during the investigation, which refers to the suspicion that he shot the vehicle in which Drecun and Mašanović were, that he was then in a nervous breakdown due to the death of Marković.
"At the place I was, I did not react consciously. Even now I can't even remember what happened and remember everything, except that I saw tears and sadness in the eyes of Haris Kočan for his friend", said the accused Vanja Burda and added that he was very sorry for the murder of Radovan Marković.
Senior State Prosecutor Snežana Šišević said that she stands by the allegations in the indictment. She added that the evidence collected in the investigation, individually and collectively, undoubtedly confirms the suspicion that the accused committed the criminal acts for which they are charged. She added that in their defenses, the accused admitted to the commission of the crime.
"I emphasize the special importance of the DNA expertise, which I appreciate fully confirms the commission of all the criminal acts for which the defendants are charged - the prosecutor pointed out. She proposed to the court to confirm the indictment.
Haris Kočan, from Beran, was arrested in April on suspicion of murdering Radovan Marković. The prosecution also charges him with the attempted murder of Nikola Drecun and Igor Mašanović in Cetinje on November 20 last year.
As previously announced by Acting Assistant Director for the Anti-Crime Sector Lazar Šćepanović, Haris Kočan, he is also suspected of having activated the so-called hand-held rocket launcher. Zolja, on which occasion the targets of the attack were members of a cell of a criminal group from Cetinje - Nikola Drecun and Igor Mašanović.
"It is suspected that the direct perpetrator of this act is HK, who during the implementation of the criminal plan directly fired a grenade from a hand-held rocket launcher in the direction of the vehicle in which the injured IM and ND were located. Regarding the direct perpetrator, we have information that he was employed in the previous period in the Army of Montenegro and underwent training in the handling of various types of firearms and training in the handling of a manual rocket launcher", pointed out Šćepanović earlier.
