The Judicial Council will most likely not wait long to schedule a session where they will conduct an interview with the former representative of the state before the Court in Strasbourg Valentin Pavličić, which could be before the members of that body as early as next week.
At yesterday's General Session of the Supreme Court, Pavličić received the support of the judges of that instance and thereby skipped the most important step, so now she is on the verge of taking over the leadership of the court system for a full term.
Today, the Supreme Court will send a reasoned proposal to the Judicial Council, after which there will no longer be any obstacles for that body to immediately schedule a session at which it will decide whether Pavličić will receive support for a full mandate at the head of the umbrella court instance.
Valentina Pavličić, who is currently the national consultant of the Council of Europe for the rule of law regarding the implementation of judgments of the European Court of Human Rights in the national judicial system, at the session of the Judicial Council, a two-thirds majority of the members of that body will be needed in order for the judicial system to get a president after almost four years. in full term.
During the secret ballot, out of 15 judges who participated in the work of the General Session, Pavličić won ten, the President of the Administrative Court Miodrag Pešić seven, while they are acting presidents of the Supreme Court Vesna Vuckovic and Supreme Court judge Ana Vuković received six votes each.
Before the secret ballot, Supreme Court judges conducted interviews with the candidates, and for the first time the General Session was open to the public, after the Rules of Procedure were changed in October.
In the introductory part, Valentina Pavličić presented her view of what kind of person should be in the leading position of the Supreme Court and emphasized that "it has never been a more difficult moment for Montenegrin judges".
"The honor and reputation of the judicial profession should be defended. The Supreme Court, headed by the president, should be the pinnacle or beacon of justice," said Pavličić.
She stated that her vision is to preserve, develop and strengthen everything that has turned out to be good... She also referred to key segments from the work program, which she wrote on over 60 pages.
"What has never been done in the court system is a functional analysis of the judiciary. That would be a good tool for dealing with the causes that led to that situation. Rather than just putting out fires," she stated.
She also referred to the situation in the Special Department of the High Court in Podgorica, noting that there are 169 unfinished cases in that department as of today.
"The attitude of the entire system towards the category of special cases must be changed. We need to have a planned analysis. It is up to us to resolve these cases, to create a good environment and to strengthen those judges to make good judgments in the first instance," said Pavličić.
She believes that the fairness of the procedure as a whole should be ensured, because "justice must be seen and shared, not just shared".
