The Supreme Court adopted the request for the protection of legality that the Supreme State Prosecutor's Office (VDT) raised against the legally binding decision of the High Court in Podgorica on the cancellation of the temporary measure of securing movable and immovable property of the MoJ, which violated the law in favor of the defendant.
VDT said that the request for the protection of legality was raised due to a significant violation of the provisions of the criminal procedure in connection with the Law on confiscation of property benefits obtained through criminal activity.
As they explained, acting in the case of the Special State Prosecutor's Office (SST), the criminal panel of the High Court in Podgorica accepted the appeal of the defendant's defense attorneys and canceled the temporary security measure, which is in accordance with the Law on confiscation of the proceeds of crime, on December 8 last year. , brought by the investigating judge.
By the decision of the investigating judge, initially, at the proposal of the SDT, a temporary measure was set to ensure the prohibition of the disposal of more real estate, as well as the temporary confiscation (seizure) of the movable property of the defendant MJ and his related persons.
VDT said that it is about property that SDT suspects to have been acquired through criminal activity, one part of which, i.e. a 100 square meter residential area in Bar, was subject to sale after the decision of the High Court to lift the temporary security measure.
"The Supreme Court found that in the decision of the High Court on the cancellation of the temporary measure, completely unclear and to a considerable extent contradictory reasons were presented regarding decisive facts, while the wording of the contested decision contradicts itself", according to the statement of the VDT.
