The family members of the late Svetislav Milošević and their legal representative announced today that the victim did not have any birth defect, as claimed by the expert in the report.

Before the criminal panel of the Court of Appeal, the trial of the defendant Igor Laković continued yesterday, accused of having committed a criminal offense - grievous bodily harm with fatal consequences.

The higher court in Podgorica twice pronounced a first-instance verdict by which Laković was sentenced to two years in prison, because on November 10, 2021, he punched Milošević in the area of the left side of the head, who died four days later in the Clinical Center.

Forensic medicine expert Dr. Nemanja Radojević said that he stands by his earlier statements, when he stated congenital anomalies of the blood vessels as the cause of Milosevic's death, and then explained in detail.

"The anomaly I spoke about earlier is adequately documented and verifiable by any expert," said the expert.

He said that after the autopsy, he spoke with members of the Milošević family: "I received information that another family member had a problem with blood vessels."

Svetlana Milić, the victim's sister, said that there was no such conversation with the expert and that it was not true that any of the family had a problem with blood vessels.

"Earlier, he said that death occurred as a result of a strong blow to the left side of the head with his hand or some object. He said this in front of family members. He did not mention blood vessel anomalies at the time, he added that later," she pointed out.

Judge Predrag Tabaš reminded that the expert stated in the report that a very strong force was applied, squeezed with a fist in the eye area, after which the blood vessels in the brain burst, which led to death, adding that this fact was not questioned .

Answering the court's questions, Dr. Radojević made a detailed statement. He said there was an effusion of blood from the space from the rupture of the right posterior cerebral artery, which led to death.

"And that happened because of the personal characteristics of the injured person. Specifically, the personal characteristic of the organism was reflected in the fact that the arteries of the brain were innately thin. Individual like spider threads, and that to tear some of the arteries, incomparably less force is required than it would have been it is necessary for such an injury to have occurred in a healthy person. When a person who has such blood vessels has no subjective symptoms, he has a higher risk of having a stroke. We cannot know whether this would happen," he pointed out Radojevic.

He added an example from practice from his specialization in Belgrade, that a man's blood vessel burst from a slap.

"If there was no personal characteristic, i.e. if the arteries had a normal appearance, thickness, size and diameter, most probably the artery would not have ruptured," said the expert.

Answering questions from lawyer Nebojša Asanović, representative of the Milošević family, expert witness Radojević stated that as a result of the blow, the head made a sudden rotational movement when the muscle and artery were torn.

"Most likely, the artery would not rupture in a healthy person, but I cannot rule it out," he stated.

The representative of the family, Svetlana Milić, said that her brother was not sick, but was doing heavy physical work, and that it does not correspond to what the expert said.

Lawyer Nebojša Asanović objected to the expert's testimony, stating that Svetislav Milošević did not have the congenital defect referred to by the expert.

"It is not true that he had a congenital defect, because he underwent a series of specialist examinations as a professional driver and this defect was not recorded in the medical record. It is not true that after the autopsy he mentioned congenital artery disease to his family as a personal characteristic. I believe that the expert report is incomplete in relation to as a result, because the Court of Appeal determined that as a reason to cancel the first-instance verdict. That was one of the reasons for the cancellation," said lawyer Asanović.

According to the indictment, on the night of November 10, 2021, in Radosava Burić Street, due to a parking space, defendant Laković hit Milošević, after which he fell.

He died four days later in the Clinical Center of Montenegro. As stated in the indictment, Laković punched Milošević in the left side of the head, although he was aware that he could seriously injure him in this way, so he agreed to it.

"The defendant inflicted a serious and life-threatening physical injury on the injured party, for which he was treated in KCCG until November 14, 2021, when his death occurred, and in relation to which consequence - the death of the injured party, the defendant acted negligently, i.e. he knew that his actions may lead to such a consequence, but he thought lightly that it would not occur 151 paragraph 3 in connection with paragraph 2 of the Criminal Code of Montenegro," the indictment states.
