The trial of the defendants for the murders of Nemanja Prelević (28) and Danilo Peković (20) in Veruša in October 2020, for which Marko Zekić and eight other persons were accused, continued today in the High Court in Podgorica with the presentation of written evidence.
Attorney Stefan Jovanović, the defendant Zekić's defense attorney, stated that no gsr particles, no gunpowder particles, DNA, or anything in the material sense that would link the defendants to the commission of the crime were found.
"No expert report connects any defendant with this criminal legal event, because absolutely no material evidence was found," said Jovanović.
The court will call all the experts who made the findings, to the hearing of the main trial, so that the prosecution, the defense and the court have the opportunity to ask questions. During the evidentiary proceedings, video surveillance from the camera of the "Jugopetrol" pump station in the town of Rudeš near Beran was viewed.
According to the indictment, 18.11.2021. around 22:XNUMX p.m. near the General Hospital in Berane, Zekić, from a vehicle driven by Miomir Đukić, shot the Sujković brothers Ismet and Kenan and Mirza Kastrata, who were then in the Passat.
The defense lawyers stated that Đukić's defense was confirmed, that he and Zekić were at this pump, almost at the time when the shooting happened in Berane, where they stayed for a long time. They added that this evidence is important because the Jugopetrol pump is located about 16 kilometers from the town of Zabrđe near Andrijevica, where the burning "Golf 4" was found, and that the gas station is three kilometers from the shooting site near the General Hospital in Berane.
In the video, the defendants were found in another car of the brand "Audi A4", a burgundy station wagon.
Lawyer Dragana Vojinović, Đukić's defense attorney, proposed that a traffic expert be conducted. The task of the traffic expert would be to undisputedly establish the distance from the place where the shooting took place to the Yugopetrol pump where the defendants were recorded by the video surveillance camera, as well as the time required to cover this distance.
Lawyers Drago Konatar and Stefan Jovanović agreed with the proposal of lawyer Vojinović.
"Taking into account the nature of this traffic expert evidence, and the fact that it does not take a lot of time to present the evidence, because it is very significant because it confirms the defense of the defendants," said lawyer Jovanović. The Special State Prosecutor's Office in Podgorica filed an indictment against the eight-member criminal organization of the accused Marko Zekić, who is on the run.
In addition to Zekić, Miomir Đukić, Dragan Biletić, Vasilije Đukić, Mirčeta Mihailović, Nenad Miličić, Goran Milašinović, Branislav Ivanović and Dragan Tarić are also accused. According to the collected evidence, Marko Zekić, Vasilije Đukić and Mihailović killed Prelević and Peković together on October 17, 2020, in the town of Uvač, with premeditation and prior agreement.
Milašinović, Biletić, Ivanović and Miličić assisted in the serious murder of two Podgorica residents by deliberately creating conditions and removing obstacles. The task of part of the group was to monitor the movement of Prelević and Peković in order to determine the most favorable place and time for their liquidation.
"After they found out that the targets would be in Prelević's house in the town of Uvač on October 17, they communicated that information to Zekić, Đukić and Mirčeta Mihailović, who went to Veruša," the indictment reads. It is added that Mirčeta Mihailović handed over an automatic rifle and a pistol to Zekić and Đukić, who, after a brief discussion at the door of the cottage, killed Prelević by firing several projectiles into his head and upper body. After killing Prelević, they entered the cottage and killed Peković. Transcripts of the Sky application used by members of this criminal organization revealed that the murder of Prelevic and Pekovic was planned several months earlier. Marko Zekić from Beran had a physical confrontation with Nemanja Prelević in a bar in Podgorica, after which he made the decision to kill him, so he informed the other members of the criminal organization he founded, among other things, the indictment states.
In the explanation of the indictment, it is written that, according to evidence from France, Zekić informed the other defendants about the conflict he had in a Podgorica bar, through the Sky application, and told them that he had made the decision to kill Prelevic.
"From further communications from August 05.08.2020, XNUMX, Zekić announces that he made the decision to take the life of Nemanja Prelevic precisely because of the fight he had with him and with Vladimir Bajčeta and Marinka Banović in the restaurant. In those messages, Zekić states that he is with had a gun that he had left and at the same time inquires with other defendants where Prelevic lives, what vehicle he drives, and where his house is located, i.e. what is the street where the victim's house is located," the indictment explains.
The court will request a report from the Forensic Center
The court stated today that the case file lacks an expert report on the shooting distance. The president of the special panel of judges, Vesna Kovačević, stated that the report was described in the indictment and cited as evidence, but that she did not have it in the case file. The court will request this report from the Forensic Center.
It was also established that the testimony of one witness, i.e. the record of the hearing, is also missing.
Lawyer Stefan Jovanović said that it is inadmissible that these two pieces of evidence are missing and that the indictment has been confirmed, and this case has already been tried for two years, regardless of the probative value of these pieces of evidence.
