The decision of the pre-trial panel of the Higher Court in Podgorica confirmed the indictment filed by the Higher State Prosecutor's Office in Podgorica against Haris Kočan for the criminal offense of attempted aggravated murder against Nikola Drecun and Igor Mašanović, and Vanja Burda for the murder of Radovan Marković.
The indictment states that on November 20, 2023, at around 18.30:40.000 p.m., Kočan attempted to kill Mašanović and Drecun with intent for selfish gain. By accepting a proposal from an unknown person, who hired him to fire a projectile from an RPG-70.000 rocket launcher into a vehicle at a predetermined location in Cetinje for an unspecified amount of money, ranging from 7 to 20 euros. As a result, on November 2023, 5, in the afternoon, in a vehicle without license plates, in which, contrary to Article 1, paragraph 33 and Article 1, paragraph 7 of the Law on Weapons, he unauthorizedly held and carried in a public place a firearm of great destructive power, the RPG-XNUMX rocket launcher.
The defendant, carrying a marked RPG-7 rocket launcher in his hands, waited in ambush for the vehicle carrying the injured parties Mašanović and Drecun to arrive. After noticing the arrival of the vehicle carrying the injured parties, he fired an anti-tank anti-armor grenade with a cumulative rocket from the aforementioned firearm at it, which hit the ground in front of the passenger side of the vehicle, which was damaged at that time. After which he fled the scene in a vehicle without license plates and drove to Podgorica, where he threw the vehicle and the firearm into the Morača River near the bridge. By doing so, he committed the criminal offense of attempted aggravated murder under Article 144, paragraphs 4 and 8 in conjunction with Article 20 of the Criminal Code of Montenegro and the criminal offense of illegal possession of weapons and explosives under Article 403, paragraph 3 in conjunction with paragraphs 2 and 1 of the Criminal Code of Montenegro, the indictment states.
The second count of the indictment states that on March 3, 2024, in the town of Meterizi near the main road Podgorica - Cetinje, the defendant Kočan intentionally killed Radovan Marković. While he was in the vehicle with the injured party, sitting in the back seat, and the injured party in the driver's seat, while the vehicle was in motion, he fired several projectiles from an automatic rifle in the direction of the injured party, two of which hit the injured party in the back, resulting in the injury that caused the injured party's death.
After Kočan killed Marković, the defendant Burda, who was sitting in the passenger seat, and in order to help Kočan conceal the means with which he committed the crime of murder and the resulting traces, doused the vehicle in which all three of them were previously in with gasoline, and used a lighter to create a flame that caused a fire in the vehicle. The next day, at around 11,15:XNUMX a.m. in a public place, when he was stopped by police officers, he was unauthorizedly holding and carrying a firearm with erased markings, namely a pistol of the brand "Češka zbrojevka".
Kočan committed the criminal offense of murder under Article 143 of the Criminal Code of Montenegro and the criminal offense of illegal possession and carrying of weapons and explosives, and Burda committed the criminal offense of assisting the perpetrator after the commission of a criminal offense under Article 387, paragraph 2 in connection with paragraph 1 of the Criminal Code of Montenegro and the criminal offense of illegal possession and carrying of weapons and explosives, the indictment states.
