A one-year suspended sentence is not appropriate if the crime has been proven, and it is even less appropriate to punish an innocent person for an unproven crime, especially if there is evidence that the crime was not committed, Dejan Ban, one of the owners of the company "Pomorski saobraćaj", announced today.
He reacted to today's statement by the Independent Police Union of Montenegro, which states, among other things, that Ban was sentenced to 30 days in prison on probation for attacking a police officer, and that with this verdict, the judge of the Basic Court in Kotor, Danijela Samardžić, "obviously lightly throws the police uniform underfoot, belittles the importance of the police in society and shows that citizens are not protected either."

Ban said that qualifying people based on uncontested verdicts almost certainly leads to error.
"Moreover, it is not only a mistake, but also points to the conclusion of an unbridled desire to cause damage. If, in fact, the authors of the publication are losing patience and cannot wait for the final outcome of the proceedings, it would have been correct to point out that these are assessments made by those involved. Based on a non-final verdict," Ban pointed out in a statement.
He added that in any case, each party has the right to secondary protection.
"He has the right to point out shortcomings in the procedure and shortcomings in the assessment of the factual situation. As for the assessment in the statement regarding the length of the sentence imposed, I share your opinion. A one-year suspended sentence is not appropriate if the crime has been proven. It is even less appropriate to punish an innocent man for an unproven crime. Especially if there is evidence that the crime was not committed," Ban said.
