The Council of the Podgorica Higher Court confirmed the indictment against Nikola Raičević, a resident of Podgorica, whom the Special State Prosecutor's Office charges with the criminal offense of creating a criminal organization, the continued criminal offense of smuggling, and two criminal offenses of unlawful influence through aiding and abetting.
Raičević is, according to the allegations, part of the criminal group of Miloš Medenica, the son of the former president of the Supreme Court, Vesna Medenica.
"The subject of the indictment is the activities of a criminal organization organized in 2019 in Montenegro by the accused MM, whose members became the accused, natural persons: VM, MV, MM, LB, PM, IK, RR, SK, MB, GJ and the legal entity KC DOO N. and other unknown persons, with the aim of committing the criminal offenses of smuggling and unlawful influence, and for the purpose of acquiring illegal profit and power, whereby each member of the criminal organization had a predetermined task and role, its activities were planned for an unlimited period, and were based on the application of certain rules of internal control and discipline of members, in whose actions there was a readiness to use violence and intimidation and economic and business structures were used, and the criminal organization had influence on the judicial authorities and other important social facts, and there was also an influence of the criminal organization on the judicial authorities and other important social factors," the SDT, headed by Vladimir Novović, announced.
They explained that the subject of the indictment is the actions of the accused Raičević as a member of a criminal organization, and within its criminal plan, by which he recruited the accused Etra Milutinović to create false documents and find officials of the Customs Administration who would accept such false documents in the performance of their duties as genuine, all in order to use them to smuggle untaxed cigarettes from the Free Customs Zone of the Port of Bar to the customs territory of Montenegro, by transferring them across the customs line, while avoiding customs supervision measures.
"And finally, the subject of the indictment is the action of the accused NR, within the criminal plan of the criminal organization, who, on the orders of its accused organizer, the son of the accused VM, the then president of the Supreme Court of Montenegro, communicated with the accused MP and BP and VP, with the aim of reaching a corrupt agreement that the accused mediate so that the civil cases and proceedings that were pending before the Montenegrin courts are concluded in favor of the defendants, regardless of the factual situation, and that in return the accused MP and BP, that is, the accused VP, whose families are the owners of the defendant legal entities, give a bribe in the form of three apartments in Budva, with parking spaces and money of €9.600, i.e. in the form of money of €150.000, which the accused NR took from the accused VP, for the account of the organizer of the criminal organization and his mother, as a member of it," said the SDT.
They pointed out that, at the proposal of the Special State Prosecutor's Office, after the indictment was filed, he was recommended for detention, and the indictment proposed that, after confirmation, the criminal proceedings be merged with the criminal proceedings ongoing before the High Court in Podgorica against the other defendants, pursuant to the confirmed indictment of the Special State Prosecutor's Office, dated October 17, 2022, in order to conduct a single proceeding and issue a single verdict, according to which the main trial was set for February 28 of this year.
