The Criminal Chamber of the Higher Court in Podgorica, presided over by Judge Sonja Keković, sentenced the accused Igor R. Nikić (44) to a single sentence of 15 years and six months in prison for the murder of Dragan Ševaljević (40) and illegal possession of weapons.
For the criminal offenses charged against him in the indictment, a prison sentence of 14 years and eight months was previously determined for the criminal offense of murder and a prison sentence of one year for the illegal possession of weapons and explosives. The court then imposed a single prison sentence.
According to the indictment, on October 15, 10, at around 2022:22,30 p.m., in the "Barley Pub" restaurant on Vaka Đurovića Street in Podgorica, after a verbal and physical altercation, Igor Nikić intentionally killed the injured party Dragan Ševaljević, aware of his actions, the commission of which he wanted and knowing that they were prohibited.
By using a pistol of unknown make and model, caliber 7,65 millimeters, which he kept without the permission of the competent authority, contrary to Article 5, paragraph 2 and Article 12 of the Law on Weapons, and carried in a public place without authorization. The defendant fired seven shots of caliber 7.65 millimeters, two of which hit the injured party Ševaljević Dragan, resulting in the injury of the injured party's death. By doing so, he committed the criminal offense of murder under Article 143 of the Criminal Code of Montenegro in conjunction with the criminal offense of illegal possession of weapons and explosives under Article 403, paragraph 1 of the Criminal Code of Montenegro.
Lawyer Maja Turković, the attorney for the injured Ševaljević family, told "Vijesti" that she was somewhat satisfied with the verdict.
"As the representative of the injured family, I can say that we are somewhat satisfied with the sentence. Although, considering the gravity of the acts committed and their consequences, namely that this is a great tragedy in which a young human life was tragically ended, with a future ahead of it, who was also a husband and father of four young children, then in that case we cannot speak of an adequate sentence and satisfaction," Turković assessed.
