Judge of the High Court in Bijelo Polje Ivan Adamović issued a decision yesterday that separates the proceedings against Rožajac Edmir Ramović, for murder Semir Murić in the center of Rožaje, almost four years ago, from the other Ramovićs accused of participating in a fight.
Ramović answers in the Higher Court that he killed fellow citizen Semir Murić and wounded a police officer in a ruthless revenge Refik Dedeić.
Near Elsana Ramović for participating in a fight are also responsible Salka (51) Ernes i Ernad Ramović, while Sabro Ramović (55) is charged with illegal possession of weapons and the case will continue before the Basic Court in Rožaje.
The hearing was previously adjourned for an hour and a half, and the decision to separate was made after, in the meantime, a medical expert determined that, based on the medical documentation submitted to him, Elsan Ramović was not capable of following the court proceedings.
Ramović's trial has been postponed several times, and the three-year period from the filing of the indictment is about to expire, meaning the accused could soon be released.
Defense attorney Dear Konatar He said that such a decision does not serve the purpose of the proceedings and recalled that the three-year detention period in law and under international law is given as a period that protects the defendant from excessive detention, and not to the detriment of the proceedings.
The lawyer said that the proceedings were divided to the detriment of the truth, that it puts the accused in a significantly more difficult position, by depriving him of five statements that are in his favor, namely the defenses of his co-accused.
He asked the court to join the proceedings before the Basic Court in Berane, instead of separating them, in which a larger number of defendants from this proceeding participate and in which the defendants also include those who were injured, and which the prosecution cites as the reason and motive for the event, which is being tried in the Higher Court, because this is the only way to establish decisive facts for the defendants.
The court rejected such a proposal after deliberation, but the hearing was ultimately adjourned after the state prosecutor Tanja Nišavić requested an adjournment for consideration and possible changes to the factual description of the indictment, due to new circumstances caused by the separation of the proceedings.
