Businessman Zoran Ćoćo Bećirović was of impaired mental capacity, but not significantly so, at the time of the attack on "Pobjeda" journalist Ana Raičković, according to the findings of psychiatric expert Željko Golubović.
He said this at today's hearing at the Podgorica Basic Court in the case against Bećirović, his son Luka Bećirović, Mladen Mijatović and Ljubiša Dukić for the attack on Raičković.
Expert witness Golubović also assessed that Mijatović's ability to understand the significance of his actions and the ability to control his actions was "significantly reduced" at the time of the crime, due to the blow he received from Raičković's son, Uroš Gagović.
"This is a mentally healthy person and there are no indications for a security measure," Golubović said of Mijatović.
This expert assessed that Luka Bećirović's ability to reason that night was reduced due to the presence of alcohol.
"...The mutual exchange of blows is a circumstance that leads to increased emotional arousal of the defendant, which corresponds to the affect of irritation and anger of medium intensity, the state of consciousness is preserved, intellectual and cognitive functions are preserved, but acute alcohol intoxication leads to reduced self-control, the person reacts more violently to a small stressful event, there is an affective search in the sense of the defendant's physical movement, that is, there is a release of internal psychological tension and anxiety caused by the tortuous situation, therefore alcohol accelerated aggressive behavior at the time of the criminal act," said expert witness Golubović, assessing the condition of the defendant Luka Bećirović from that night.
The legal representative of journalist Raičkovič, attorney Srdan Kažić, proposed that the Basic Court inspect the recording that she made on the evening in question and which is on her phone.
Judge Ilija Radulović adopted the proposal and will engage digital forensics expert Nikola Smiljanić.
"... which will aim to seize video recordings and photographs that were made on the critical day at the time of the event in question in front of the Gurman restaurant. The expert witness will also give a separate statement regarding the authenticity of the recordings and any changes to them," said Judge Radulović.
The defendants' defense attorney, Danilo Mićović, proposed that the defendants' detention be lifted because, as he said, detention is turning into a sentence.
"If it were anyone else, the detention would not have lasted five months, and the only reason it is lasting this long is because it is Zoran Bećirović," said Mićović.
The court rejected his proposal.
