"The court accepted the proposal to issue a temporary measure by the Special State Prosecutor's Office. The immovable and movable property in question clearly represents property of great value. According to official data, the defendants Stefan and Martin Janković are unemployed persons, because they do not pass through the database of the Insurance Fund, the Pension and Disability Insurance Fund in terms of insurance years, earnings, salary compensation, insurance bases and the amount of paid contributions. From the data obtained by the Tax Administration, it follows that the defendants do not appear as founders or responsible persons in companies registered on the territory of Montenegro, nor are they registered as taxpayers in the Tax Administration databases. Therefore, in the court's opinion, it is obvious that the property in question is disproportionate to legal income, because they do not generate legal income and the only conclusion that the court can draw is that there is a reasonable suspicion that the property that is the subject of this temporary measure was acquired through criminal activity," wrote Judge Šćepanović in the ruling.

He explained that the Law on the Confiscation of Proceeds of Crime provides for temporary measures in cases where there is reasonable suspicion that the property was acquired illegally:

"And in the opinion of the court, the existence of this suspicion has been unequivocally established... When all of the above is brought into connection with the aforementioned legal provisions, in the opinion of the investigating judge, it is made probable that there is a well-founded suspicion that the property from the enacting clause of this decision was acquired through criminal activity, as already stated, and that there is a risk that the confiscation of this property will later be prevented or made more difficult. In relation to the aforementioned property, there is an obvious disproportion between the value of this property and the lawful income of the person in relation to whom the temporary measure was issued, which is why the decision to impose the temporary measure was issued," the decision states.
