Podgorica Pero Rakcevic (55) at the end of March he left for Berane to pick up heroin, which he then gave to his wife, M. M. R. to hide it in a bra. The drugs were found by a Kolašin police officer after the two were detained for a traffic violation.
At the hearing before the Bijelo Polje prosecutor, Rakčević claimed that his wife did not know what was in the bag he gave her, and that she only fulfilled his request to hide it in her bra.
He said that he had previously asked his wife to go to Berane to look at the plots, but did not mention the real reason - to go get drugs. He also claimed that he did not know who had left him 174 grams of heroin and that he did not know who to give it to in Podgorica, stating that he should have left it next to a tree.
This is stated in the decision of the Bijelo Polje High Court, which refused to release the fifty-five-year-old man to defend himself from charges of committing the criminal offense of unauthorized production, possession and distribution of narcotic drugs.
Rakčević was arrested on March 27, and the police announced at the time that the Podgorica resident, who according to their claims is a person of operational interest, was driving a car with Podgorica license plates under the influence of heroin.
They found about 170 grams of the drug during a subsequent search, and three days later, by a decision of the investigating judge, Rakčević was ordered to be detained for up to 30 days.
His defense attorney appealed that decision, but the appeal was rejected by a panel of the High Court consisting of judges Milan Smolović and his colleagues Bojana Radović i Dragan Dasic.
In deciding to keep Rakčević in custody, the judges also cited his defense given during the hearing at the Higher State Prosecutor's Office in Bijelo Polje.
According to court documents, he told the prosecutor that on March 27, at around 8.30:XNUMX a.m., he "slowly" set off from Podgorica towards Berane, accompanied by his wife, whom he had "asked the previous day to go with him to Berane to look at some plots of land."
"On that occasion, he did not tell his wife the real reason, namely that he was going to Berane to pick up the narcotic drug heroin, which he would transport to Podgorica on the same day," he claimed before the prosecutor.
He also told him that he had arranged to pick up the drugs over the phone, with a person whose name he did not know:
"The agreement was that the narcotic drug heroin, packed in a small bag and a package, would be left near the Berane - Kolašin road, more precisely after the tunnel, seen from the direction of Kolašin, next to a tree. After taking possession of the narcotic drug, he intended to transport it to Podgorica and leave it in a small park, about 300 meters from Gintaš, more precisely next to a tree and a small bench. For the transport of this narcotic drug, he was supposed to receive money in the amount of 400,00 euros, which was supposed to be paid to him no later than 28 March 3," the suspect claimed during the hearing.
He explained that he did so and that he stopped at an extension on the right side when viewed from the direction of Kolašin, which is located after the tunnel towards Berane.
Allegedly, he told his wife that he had to see something, so he got out of the vehicle, walked a few dozen meters and took a PVC bag containing a smaller PVC bag, and a handmade package containing heroin.
He also claimed that he returned to the vehicle with the drugs and headed back towards Podgorica, and that during the journey towards Kolašin he handed his wife a bag:
"And he told her to put this in her bra, which she did, he told her that there was nothing wrong with the bag and that it was not a narcotic. On the same day, at around 11.20:XNUMX a.m., police officers stopped him in Kolašin. On that occasion, they tested him for psychoactive substances and he tested positive, so they took him and his wife to the police station where they examined his body. At the police station, police officers from the Kolašin Police Department performed an external examination of his wife's body, during which they found a small bag and a package containing heroin in her bra," the judges quote his statement in the ruling.
He could escape, repeat the crime and influence the witness.
Rakčević's detention was confirmed on several grounds - due to the risk of flight, influence on the witness, his wife, but also due to the risk of repeating the criminal offense, because he has already been convicted by a final and binding verdict for the same crime.
"As the investigating judge provided clear and valid reasons, accepted by the panel of this court, for the detention grounds referred to in Article 175, paragraph 1, items 1, 2 and 3 of the Code of Criminal Procedure, and the decisive facts that he took into account when ordering the detention of the defendant, all of the above indicates that detention against this defendant is a necessary and justified measure for the time being, and that at this stage of the proceedings the same purpose cannot be achieved by a measure less lenient than detention, as the defense counsel proposed in the appeal," the panel of judges assessed.
The files state that this Podgorica resident is charged with committing the criminal offense of unauthorized production, possession and distribution of narcotic drugs on March 27, 2025, by illegally transporting 174,5 grams of heroin, in two handmade plastic bag packages, from the direction of Berane to Podgorica, to a "pole" owned by his wife, for the purpose of sale.
