"Scumbag and a *** - can you see her in her leather pants?" - these are the words Zoran Ćoćo Bećirović addressed "Pobjeda" journalist Ana Raičković in a recording from her phone that was produced today in the Podgorica Basic Court.
The recording was examined by forensic and digital expert Nikola Cmiljanić, who said that the recording from Raičković's phone was authentic.
This is a recording that Raičković recorded with her phone on the night of the incident, November 10th last year in Podgorica.
The defendant Mladen Mijatović gets up from the table and approaches Raičković, who is walking in his direction. A female voice is heard saying, "Why shouldn't I film her, why should she curse me, who should tell me to f**k me?", to which Mijatović replies, "Who's cursing you?", and then Raičković continues, "So first get away from me because you smell of alcohol?", to which Mijatović replies, "Fuck you.", after which Raičković approaches the table where the defendant is sitting and films Bećirović, who says, "Fuck you, you s***, don't film me. You s***, you s***, don't film me," to which Raičković replies, "You're going to tell me that, aren't you?", and Bećirović continues, "Do you see her in leather pants, you s***, don't film me, let her film me?" to which Raičković repeats "shame on you" twice, and Bećirović replies, "shame on you, you s***."
Luka Bećirović is sitting at Bećirović's table, who is not commenting on anything, as is the defendant Ljubiša Dukić, who is also not saying anything, and Mijatović is standing between Bećirović and Dukić.
At the end of the recording, Raičković said to Bećirović, "Shame on you, you scoundrel."
The defendants' defense attorney, Matija Bulatović, said that the video footage contradicted what Raičković said in her statement, which was that she failed to record the event because Mladen Mijatović prevented her from doing so.
"I propose that this material be submitted to the competent prosecutor's office to investigate whether it contains elements of the criminal offense of illegal filming," said defense attorney Bulatović.
Raičković said that the recording shows the presence of waiter Milivoje Purić, who was summoned as a witness, but was never served with the summons. Her lawyer, Miloš Vuksanović, recalled Milivoje Purić's statement to the prosecutor that he was not outside during the incident and did not hear anything.
"As we could see, Purić was shown on the recording, so I believe it is completely clear that with his statement that you read at the main trial, he avoided telling the truth and that for that reason the procedural decision that read the statement of that witness should be revoked and that he should be heard again," Vuksanović proposed - which the court rejected.
The defense requested the termination of detention for Mijatović and Bećirović, which Judge Ilija Radulović refused.
