Danilo Mandić's defense attorney, lawyer Miroja Jovanović, requested that prosecutor Jelena Protić be excluded from the proceedings, explaining that he was doing so due to justified doubts about her impartiality and because of specific actions that led to a serious violation of the defendant's and his defense attorney's right to defense.
He explained that he was doing this because witness UR was questioned this morning, and he was not informed about it in a timely manner.
In his complaint, he stated that yesterday he went to the premises of the Higher State Prosecutor's Office in Podgorica to question witness Darko Perović, which was postponed because the witness did not come, stating that he was not feeling well.
He pointed out that the prosecutor, with his consent, postponed the hearing yesterday to today at 14 p.m., and that the reason for that date was the prosecutor's previously undertaken obligations:
"Who pointed out that she could not attend the hearing before 14 p.m."
Jovanović states that because of this he postponed his return to Belgrade, even though he had a ticket to return today, and then explains that last night, after being heard by the investigating judge and receiving the decision, he wrote an appeal during the night, which he sent to the press at 5:30 am.
In his complaint, he points out that, naturally, he then fell asleep, and when he woke up around 11.20 a.m., he found messages and missed calls from the acting prosecutor, that is, that at 9.02 a.m. she sent him a message that "the witness hearing is scheduled for 10 a.m." UR, and that she then called him at 30 and 9 a.m.
"At 11:30, the defense attorney called the prosecutor, who told him that the hearing would be over soon. He expressed his disagreement for the following reasons: It was agreed that Perović's hearing would be held at 14:00 PM, the prosecutor knew that the defense attorney was preparing an urgent appeal, the appeal was filed in a timely manner with the defense attorney working all night, the sudden introduction of a new hearing jeopardized the preparation for the already agreed action," attorney Jovanović wrote in the appeal for disqualification.
He pointed out that such actions by Prosecutor Protić violated the defendant's right to a fair and just trial, guaranteed by Article 6 of the European Convention for the Protection of Human Rights and Fundamental Freedoms.
The brother-in-law of Parliament Speaker Andrija Mandić is suspected of wounding two people - Darko Perović and Aris Turković - with a firearm on the night between Friday and Saturday, at around 3.40:XNUMX a.m., on Ivana Crnojevića Boulevard in Podgorica.
He was remanded in custody for up to 30 days last night after a hearing at the Higher Court in Podgorica.
