Afghan SK (31) will be expelled from Montenegro after serving 16 days in a Skopje prison.
This is the decision of the President of the Budva Minor Offences Court, Judge Marko Đukanović, who issued this verdict because the defendant is illegally residing in Montenegro.
As Vijesti learned, police officers yesterday determined that SK had exceeded the permitted stay prescribed by the Regulation on the Visa Regime of Montenegro.
Namely, the aforementioned regulation stipulates, among other things, that foreign citizens can enter, transit through the territory and stay in Montenegro for up to 90 days without a visa with a valid travel document. The Law on Foreigners stipulates that a foreigner can stay in Montenegro for a maximum of 90 days in a period of 180 days counting from the date of first entry, while the Afghan SK stated to the Budva police that he has been staying in Montenegro continuously for 18 months, thus violating the Law on Foreigners.
Police officers also determined that he was residing and moving in Montenegro without a valid travel document, which also constituted a misdemeanor. Judge Đukanović issued a decision on expulsion and imposed two fines of 200 euros each for the committed offenses.
The total fine of 400 euros was commuted to a 16-day prison sentence because the defendant did not have the money to pay. After his release from prison, the Police Directorate will implement a measure of expulsion from Montenegro.
